Summary of EHRC EIA
EHRC acknowledges that there are potentially negative impacts for those with the protected characteristic of gender reassignment from the updates to the Code as a result of how service providers implement
FWS.
They state that whilst this may have a negative impact on trans people with a GRC (current or future certificate holders), their view is that it is important the guidance accurately reflects the correct legal position.
EHRC note that these updates reflect the law and will facilitate a better understanding of legal obligations and entitlements. These changes aim
to mitigate the risk of unlawful discrimination or harassment by helping service providers balance the benefits, needs and impacts across potential user groups. Subsequently, this will assist providers in determining whether separate or single-sex provision meets the proportionality test. They state they sought to limit any negative effect in accessing services for those with the protected characteristic of gender reassignment by advising service providers to consider alternatives and mitigations to separate and single-sex services.
OEO additional impact assessment
As set out in EHRC's ElA, the updates to the Code are expected to have a significant impact on people with the protected characteristic of gender reassignment. In addition to the concerns detailed in that EIA, there are further impacts to note as follows.
Exclusion: The updated Chapter 13 provides guidance on when it is lawful to exclude trans people from services aligned with their acquired gender (e.g. domestic violence refuges, hospital wards, and changing rooms) based on their biological sex. It also covers competitive sport which may leave trans people with access to sport. Chapter 12 also provides guidance on restricting membership to an association based on those sharing one or more protected characteristics. Some organisations such as the Women's Institute and Girl Guiding have already made the decision to restrict…'Double exclusion': It is possible that trans people could be barred from both the space aligned with their gender (because of their sex) and the space aligned with their birth sex because of possessing the protected characteristic of gender reassignment), effectively leaving them with no service at all.
Alternative provision: While the Code states it is "unlikely to be proportionate" to leave a trans person with no service (especially for essentials like toilets), providers may lack the funding or space to offer
'third-space' or gender-neutral alternatives.
Involuntary disclosure: New guidance explains how service providers can request information about an individual's sex at birth. This may force trans people to "out" themselves in public or professional settings.
Similarly trans people have expressed concern - as in the Good Law Project litigation against EHRC - that having to use disabled toilets will
'out' them.
Policing of gender: Potential 'policing' of gender presentation, which could lead to increased harassment for trans people and cisgender people who do not conform to traditional gender stereotypes.
Safeguarding risks: Concern that excluding trans women from female services could mean they have to use male services, where they could face a disproportionate risk of violence and sexual assault (although this will depend on the nature of the service in question).
Relations between groups: The debate on single sex services and the treatment of trans people is particularly divisive at this time. The Code of Practice may exacerbate these tensions. This may be somewhat mitigated through careful communications surrounding the Code's publication.
Our assessment is therefore that the likely impacts on gender reassignment as a characteristic are negative, in relation to each of the 3 limbs of the PSED. If at first you don’t succeed, try, try again. A maxim that has been embraced by campaigners for men to be able to intrude into female spaces and for children experiencing gender distress to be pushed down a risky medical pathway, all under the misleading banner of “trans rights”. These campaigners have lost some important battles. Their strategy of bullying female opponents out of their jobs and public life ran into problems when the courts made clear that this was unlawful discrimination. Then the Supreme Court clarified that men are never women for the purpose of using female-only facilities and services.

Meanwhile the medical consensus is finally shifting to an understanding that children experiencing transitory gender distress, often a product of other issues, should be able to access exploratory therapy rather than puberty-blocking drugs.

Now gender campaigners have opened a new front, pushing for legislation to ban so-called “conversion practices”. This innocuous-sounding but dangerous Trojan horse is designed to override legal protections for single-sex spaces and to threaten parents, teachers and healthcare professionals acting in children’s best interests. Worst of all, it was adopted in Labour’s 2024 manifesto, a quid pro quo for the party dropping self-ID.

There is a long and terrible history of same-sex-attracted people being subjected to conversion practices such as electroshock therapy and corrective rape. These practices are thankfully rare, and importantly already criminal.

Badenoch is seriously unhinged. She is everything Truss was, but turned up to 11, and messianic in her isolationist beliefs that the UK must sever itself from Europe, and become more like the worst that America has to offer.

Statement on the presence of Elaine Miller at Conference:
Earlier this week we learned that a conference fringe meeting (Sunday 9am Women's pelvic health: the massive, hidden environmental cost) was due to be addressed by a notorious campaigner against trans rights, Elaine Miller. We understood this to mean she would be at conference in person. With our friends in Trans Greens and Trans Young Greens, we wrote to the party to say: “Her presence at Conference would go against the policies of trans inclusion held by the Green Party of England and Wales, and that the platforming of a renowned and vocal transphobe would represent a serious safeguarding issue for our trans, non-binary, and intersex attendees. The presence of a speaker with such a notorious history of disrupting democratic processes would constitute a serious risk of intimidating trans members out of participation in the democratic processes of their party.”We said that “We expect the party to uphold its duty to protect trans, non-binary, intersex, and gender nonconforming members” by not allowing this to happen. Sadly, as of Saturday morning, we have received no reply nor any acknowledgement beyond an automatic mailbox response. We now understand that Elaine Miller’s appearance will be via Zoom. This is a relief for many of us who are at conference. The title of the meeting is a serious and important issue relating to healthcare. However we cannot accept the platforming of a notorious campaigner against the rights of trans people. We told the party that if we did not receive assurances we would discuss with our members what steps to take next. So here we are, asking you our members to let us know what you think we should do, at conference and afterwards, to defend and protect members and to ensure that those who campaign against queer rights do not find a platform in our party. We are at stall 12, come and let us know your thoughts. Or share them with us on our socials.

Vile transphobic bigot Bridget Phillipson is leaving trans women survivors of domestic violence with nowhere to go. Trans people are particularly vulnerable to domestic violence & this disgusting government taking away support is putting lives in danger. Statement by @galopuk.bsky.social.
If the UK Government's position is, as the Minister for Women and Equalities, Bridget Phillipson, said on Sunday, that trans women should not be allowed in women's refuges, then it's their job to ensure trans+ people have accommodation they can access. Anyone who is escaping abuse and violence deserves a safe place to go.
But the Supreme Court Ruling and the EHRC's updated Code of Practice has put trans+ victims and survivors in a dangerous state of limbo with no clear guidance on what services they can turn to.
Over the last year, it has been virtually impossible for our frontline services to find anywhere safe for trans+ victims and survivors to go. Despite the fact that trans+ people are at particularly high risk of experiencing abuse and violence. We need direct action now from the UK Government to support trans+ people to find safe accommodation.

Earlier this week, I agreed to interviews with two USA Today journalists. They wrote fantastic articles about the Cornell case that I'm proud to have been a part of. What I did not know is that their employer considers interviews to proprietary and opens up recordings to be used by any journalist.
