5th Circuit? Huh. Firearm prohibitions for domestic violence offenders was also raised in Senate AG hearing today. DV Homicide rates are up across country even while other homicide rates reach historic lows. Maybe DOJ could release critical funds for prevention+response programs to save lives.

Domestic/IP abuse and violence are not in a separate category of behavior from rape, they are points along the exact same spectrum of gendered and sexualized violence. They have the same root motivations and similar impacts on survivors.

Unaffordable bail does not keep dangerous people in jail; 
it keeps poor people in jail. Without the help of organizations 
willing to help by providing free bail assistance, whether 
designated as a bail fund, church, or other nonprofit, people 
who cannot afford bail might languish in jail for weeks, 
months, or even years, while they are waiting for trial. In 
that time, they can lose their jobs, their homes, their medical 
coverage, access to medical care or medication, or even custody 
of their children.
    We know that sometimes the most effective tools for justice 
are local, nimble, and born from the communities they serve. 
H.R. 6260 is aimed directly at those very tools. It is intended 
to sever a lifeline for thousands of low-income Americans, 
leaving only a potential windfall for the for-profit commercial 
bail industry. It is yet another example of misguided, 
unnecessary federal meddling into policies that should be left 
to the states by the so-called ``party of states' rights.'' My 
Republican colleagues pay lip service to values they claim to 
hold like limited government regulation, fiscal responsibility, 
and personal liberty. Yet they champion this legislation that 
openly betrays those values.    This bill does nothing to promote public safety. Instead, 
it would stretch federal criminal laws intended to regulate the 
insurance industry to reach nonprofit bail funds. There is no 
legitimate basis to move the goalposts on the American people 
the way this bill does. Nonprofits already are subject to 
strict oversight by the Internal Revenue Service. And while 
bail funds are not insurance companies, they are subject to 
federal prohibitions against wire fraud, money laundering, and 
misuse of funds. Adding additional nonsensical layers of 
bureaucracy will not make our communities safer, but it will 
make it harder for nonprofits to help people in need.
    The vast majority of the bonds that these state and local 
bail organizations post are for non-violent crimes, and these 
organizations are already regulated by their own states. I 
challenge my Republican colleagues to explain how subjecting 
these groups to federal insurance regulations and federal 
criminal penalties will reduce violent crime. I doubt that they 
will. The evidence certainly does not support that argument. My 
Republican colleagues instead attempt to justify this bill 
through purely anecdotal evidence.

I often think that it is dt my work that when I see preliminary headlines like “lawyer killed by son-in-law” or “woman shot in alley; child missing” - I read “*another* domestic violence homicide.” Sure enough, follow up headlines inevitably connect the dots. DV homicide rates are rising.

In Dobbs v. Jackson Women's Health Organization, 597 U.S. 215
(2022), the Supreme Court returned the regulation of abortion to the states.
In response, the Biden Administration directed federal agencies to "expand access to ... medication abortion." Exec. Order No. 14076, 87 Fed. Reg. 42053 (July 8, 2022). The next year, the Food and Drug Administration (FDA) formally altered its safety guidelines for the abortion drug mifepristone. Under the new regulation, the drug could now be prescribed online and dispensed through the mail, without any need for an in-person visit to a doctor.
In 2025, Louisiana challenged the new regulation in federal court under the Administrative Procedure Act (APA). It argued that FDA's justifications for remotely dispensing mifepristone were based on flawed or nonexistent data. It also documented how the new regulation had resulted in numerous illegal abortions in Louisiana and in Louisiana paying thousands in Medicaid bills for women harmed by mifepristone. Louisiana sought a stay of the regulation while the litigation proceeded.response, FDA conceded it had failed to adequately study whether remotely prescribing mifepristone is safe. But the agency resisted staying the regulation, arguing it was in the midst of a comprehensive review of mifepristone protocols. The agency, however, could not say when that review might be complete and admitted it was still collecting data.
The district court agreed that Louisiana was likely to win its challenge
to the mifepristone regulation and was suffering irreparable harm from it.
Nonetheless, the court declined to stay the regulation based on its balancing of the equities and the public interest. Louisiana appealed to our court and sought a stay pending appeal under 5 U.S.C. § 705.
