Magistrate Judge Cyrus Chung of Colorado frees a noncitizen who ICE unlawfully arrested without a warrant. Those arrests require probable cause that someone is likely to escape before ICE can get a warrant. But the man was *in jail* and, one would assume, not likely to escape.
Here, the petitioner’s arrest lacked a lawful basis. His arrest does not comply with
section 1226(a) and the corresponding regulations because ICE did not issue an NTA or
warrant prior to his arrest. See, e.g., Quezada-Estrada, 2026 WL 1361880, at *5; MartinezSalamanca v. Baltazar, No. 26-cv-02410-PAB, 2026 WL 2083209, at *3–4 (D. Colo. July
20, 2026). And the respondents “have not provided any argument or set forth any evidence
indicating that petitioner’s warrantless arrest was proper under § 1357” and 8 C.F.R. §
287.8(c)(2). Martinez-Salamanca, 2026 WL 2083209, at *4. Nor could they. ICE
“encountered” the petitioner while he was being held by the Mesa County police. ECF No.
11 at 2. The circumstances of his arrest show that he was not likely to escape before a
warrant could be obtained because he was released to ICE from state custody. See, e.g.,

DoorDash seems to not care that ICE agents are shooting their workers while they on the job. Community members are the ones who have gotten Wilber medical attention in detention and legal support — without a single shred of help from this multibillion dollar corporation profiting off his labor.
An NBC News article reads: “Garcés Perez, who Lincoln-Goldfinch said lives in Austin, is a DoorDash driver. In an email, a company spokesperson confirmed Garcés Perez was making a delivery at the time, adding that DoorDash is investigating and would not release more information “at this time.””

Judge Varholak of Colorado continues to issue orders releasing people in immigration habeas cases and reminding the government that they need to show up next week and explain ICE's unlawful conduct to him.
This case presents one in a series of cases in which DHS appears to have simply
ignored the law and detained an individual in violation of the law. The United States has
not—and apparently cannot—defend that decision. A hearing is set for September 10,
2026 at 9:00 a.m. at which the Defendants shall be prepared to address their apparent
repeated violation of the law.
IV. CONCLUSION
For the foregoing reasons, it is ORDERED:
(1) that the Application for a Writ of Habeas Corpus Pursuant to 28 U.S.C. § 2241
[#1] is GRANTED;
(2) Respondents shall release Petitioner for DHS custody within 48 HOURS of the
date of this Court's Order; and
(3) Respondents shall file a status report within TEN DAYS of the date of this
Court's order to certify compliance; and
(4) A hearing is set for September 10, 2026 at 9:00 a.m.
