Colorado's federal judges, who are seeing record caseloads in large part because of the huge increase in immigration detention challenges, are having to spend time ordering ICE to give people back their property that even the US Attorney's Office isn't trying to defend.
Now, Petitioner requests the Court to order Respondents to return his Nicaraguan
identification card and passport. ECF No. 28. Respondents state that they “are not
submitting a brief in opposition to the Motion” and submit that, if the Court grants
Petitioner’s Motion to Enforce (ECF No. 28), the Court should “issue an order that directs
Respondents to return Petitioner’s property.” ECF No. 30 at 1. Given this response, the
Court finds that the relief requested in the Motion to Enforce (ECF No. 28) is appropriate.
Petitioner’s Petition sought his “immediate release with all of his personal property,
including any driver’s license, passport, employment authorization documents, and any
identification cards.” ECF No. 1 at 25. Respondents do not cite any authority that would
permit them to retain Petitioner’s personal property. On the contrary, courts in this District
have ordered ICE to return the personal property of released detainees. Acosta v.
Baltazar, No. 1:26-cv-03166-RMR, ECF No. 18 at 6 (D. Colo. Aug. 14, 2026); Garcia
Cortes v. Guadian, No. 1:26-CV-00294-CNS, 2026 WL 327906, at *1 (D. Colo. Feb. 6,
