Incredible opinion. It holds that the common ICE tactic of jumping out of an unidentified rental vehicle and seizing suspected noncitizens while masked violates the Fourth Amendment because the *manner* of the seizure is incompatible with a free society governed by the rule of law.

🚨HOLY CRAP. An ICE whistleblower just revealed a secret memo authorizing ICE officers to break into homes without a judicial warrant, which DHS's own legal training materials say is unconstitutional! ICE then hid the memo from the public, passing it along by word of mouth and private conversation.
The Gravamen of the Disclosure

4. The gravamen of the disclosure is as follows:
a. By memorandum dated May 12, 2025 (“the May 12 Memo”), Acting ICE Director Todd Lyons authorizes ICE agents to forcibly enter into certain people’s homes without a judicial warrant, consent, or an emergency.

b. Specifically, in the May 12 Memo, the Acting ICE Director authorized ICE Agents to rely on Form I-205 (which is not a judicial warrant) to enter the residence of an alien subject to a final order of deportation, without consent, including by “a necessary and reasonable amount of force.”2c. While addressed to “All ICE Personnel,” in practice the May 12 Memo has not been formally distributed to all personnel. Instead, the May 12 Memo has been provided to select DHS officials who are then directed to verbally brief the new policy for action. Those supervisors then show the Memo to some employees, like our clients, and direct them to read the Memo and return it to the supervisor.

So when authorities say “she tried to run over an officer,” that is not a neutral description. It is a claim of intent that can be used to justify lethal force after the fact. When the state kills first and invents the threat afterward, it is not policing, it is death squad behavior. /end

Where are my “extreme political activists and social media warriors” at? Also DSA members, since the Portland Metro Chamber apparently thinks it’s a slur. This was sent by Jon Isaacs, VP of Public Affairs.
“community stands behind you. It has long been an axiom of Portland politics that even the perception of working with business is broadly opposed by Portlanders. This message is delivered daily by Portland's deep well of extreme political activists and social media warriors. After seven years at the Chamber,
I can confidently say that, in fact, the exact opposite is true.

"A commitment to the rule of law is nonpartisan. All government officials, regardless of their party or ideology, must obey the Constitution and laws. Indeed, the very core of the rule of law is that no one is above the law." Erwin Chemerinsky, Dean at UC Berkeley Law
Full page of text, plus photo of law dean and quote. Here's as much as alt text will let me post: "Upholding the Rule of Law

As a law school, we have a special responsibility for the rule of law in our society and in the world. A commitment to the rule of law is nonpartisan. All government officials, regardless of their party or ideology, must obey the Constitution and laws. Indeed, the very core of the rule of law is that no one is above the law. Now, more than ever, UC Berkeley Law must be a force for upholding the rule of law and for using law to make people's lives better.

I have spent a great deal of time thinking about how as a law school we can respond to events that are occurring in Washington that are clearly in violation of the law: firing agency heads, inspectors general, and civil ser- vice employees in violation of federal statutes; closing agencies created by federal statutes; refusing to spend money appropriated by federal law; threatening to revoke visas for those who express particular views; and planning to move United States prisoners and detainees to El Salvador.

Part of our response is to hold a series of programs, in conjunction with our new Edley Center on Law & Democracy, to educate our students and our community. One of those events took place a week after the November election as to what the Trump administration will mean for the law, with six professors speaking to a packed lecture hall.

This semester, we are having a series of programs focused on specific issues: the environment, immigration, federal workers, reproductive justice, DEi, and others. We'll be hiring an executive director and have begun raising
funds for the center, which I see as a core part of our efforts gqing forward. Also, it is very important to provide information to those in our community
who might be affected by new policies. For example, we have provided detailed information about what students and their families can do in response to actions of the Immigrations…

Someone at the American Bar Association ate their Wheaties this morning.
ABA
It has been three weeks since Inauguration Day.
Most Americans recognize that newly elected leaders bring change. That is expected. But most Americans also expect that changes will take place in accordance with the rule of law and in an orderly manner that respects the lives of affected individuals and the work they have been asked to perform.
Instead, we see wide-scale affronts to the rule of law itself, such as attacks on constitutionally protected birthright citizenship, the dismantling of USAID and the attempts to criminalize those who support lawful programs to eliminate bias and enhance diversity.
We have seen attempts at wholesale dismantling of departments and entities created by Congress without seeking the required congressional approval to change the law. There are efforts to dismiss employees with little regard for the law and protections they merit, and social media announcements that disparage and appear to be motivated by a desire to inflame without any stated factual basis. This is chaotic. It may appeal to a few.
But it is wrong. And most Americans recognize it is wrong.
It is also contrary to the rule of law.
The American Bar Association supports the rule of law. That means holding governments, including our own, accountable under law. We stand for a legal process that is orderly and fair.
We have consistently urged the administrations of both parties to adhere to the rule of law. We stand in that familiar place again today. And we do not stand alone. Our courts stand for the rule of law as well.
