A drone is hovering above the white supremacist camp's trucks. Not sure whose it is. The size of Lang's group has remained about the same since we got on-scene. The crowd coming out to oppose them has grown significantly. Easily high hundreds of people at this point.

Will is 100% right. Has happened to multiple clients of mine. One judge (not my case) has said that this isn't really release and ordered the person *actually* released. But it's forcing us habeas attorneys to win our cases twice (or more)
On September 9, 2026, Respondents permitted Pablo F. to exit the building where 
he was detained, but he was immediately swarmed by four ICE officers and handcuffed as 
soon as he stepped outside. (Doc. No. 25-3 at 4:48:45–4:49:26.)3
 The officers drove him
to the back of the Whipple building and returned him to a holding cell. (Doc. No. 21 ¶¶ 8–
9; Doc. No. 25 ¶ 5.) During this encounter, officers dislocated Pablo F.’s shoulder. (Doc. 
No. 21 ¶ 7.)4
 Pablo F. now bringsthis Motion seeking to enforce the Court’s Order granting 
the Petition.Again, Respondents make no attempt whatsoever to support their assertion that 
Pablo F. was released. Absent any such argument, the Court cannot agree that a reasonable 
person would have felt free to leave when exiting the detention facility and immediately 
being stopped by ICE officers. Likewise, absent some argument, the Court necessarily 
concludes that Pablo F. was subject to restraints not shared by the public generally when 
he took one step outside of the detention facility and was immediately stopped by ICE 
officers who forcibly returned him to a detention cell. Because Respondents do not make 
any legal argument that Pablo F. was ever meaningfully released from custody, the Court 
grants the motion and orders Pablo F.’s release.6
6 To be clear, Pablo F. is not arguing, and the Court is not concluding, that an order of 
release in a habeas matter renders unlawful any future arrests. Rather, the Court reaches 
the narrow conclusion that because Respondents advance no legal argument in this case to 
support their assertion that Pablo F. was released from custody, and because the 
uncontested facts show that ICE officers immediately swarmed Pablo F. as soon as he 
stepped out of the building, Pablo F. was not released from custody.

You can donate to places pushing back like Immigrant Law Center of MN, National Lawyers Guild MN, ACLU etc. Yes, do vote. But talk to your friends/neighbors/family and make sure they know this is happening and that they need to vote against it. I know it can be uncomfortable but it’s worth it.

And these are families where their kids didn’t have any additional factors that made them more vulnerable—no layers of racism, ELL needs, poverty, etc. They still couldn’t get the supports their kids needed until they left.

They went to a private school specializing in certain disabilities and both their kids are in fancy private schools now. They were treated horribly in MPS. Why would they come back after the private school helped their kid MPS wouldn’t?

I know a well off family whose child cried for hours every day after school ended at Page. They moved to Edina and suddenly their kid had challenges but was actually supported and able to engage with school. I know people in SW at rich schools that refused IEPs to kids who needed them.

Most white people (who tend to be the most vicious with each other about school choice) have kids who will be fine anywhere. Many in SW have the money to supplement whatever. But even privileged people discover some harsh truths about this district when a kid needs support.

I am not even saying don’t fight the closures, or don’t make the district be explicit in what will change for the better if they do. But MPS isn’t great for everyone right now. And people who know that are sick of being chastised for suffering or simply ignored.

I swear to god, my family has so much privilege—but surviving on one income would not be possible without savings we are privileged to have, which is what we have to do post-MPS. It’s hardly a privileged position to be in. It’s just that it is abysmal for others who have additional vulnerabilities

The MPS environment—for whatever reason and through whatever decisions—is disabling and traumatizing for many kids who should not be further alienated from education access. I want to hear people care about that, and offer solutions about how to fund it if no changes are made.

We experienced three new schools last year—the MPS middle school most people say is great, a charter that probably would have been great if MPS hadn’t traumatized our kid, and the online charter that has been amazing—even though I now can’t work. Does displacement for these invisible kids matter?

Director Emerick wrote a Facebook post that I encourage you to read. This really is the experience of disabled kids at MPS right now—and the experience of their invisibility to far too many. It does usually seem to be that no one who hasn’t experienced this cares.

People do realize that students with disabilities, including chronic trauma that manifests as observable/ externalized behavior, change "placements" all the time, right?

From public to specialized charter, from federal setting Ill to IV and back, from district to district, on administrative transfer, on IEP team decision, in and out of residential treatment facilities, in and out of carceral facilities, because of push-out, because of bullying, because of neglect/abuse at school, because of LEA legal non-compliance, because of physical space/facilities access, because of programmatic or staff availability.

Students with disabilities absorb frequent changes to where they go to school because of the failures of our systems of education to serve them, teach them, keep them safe. In many cases, these placement changes actually represent a district breaking federal law, but families don't have the resources to fight back.

In almost four years on the school board I've gotten ZERO constituent emails expressing concern about how the leadership decisions that create that reality impact the friendships of students with disabilities, their sense of place and well-being, their educational trajectory, or their family capacity.

Try it with abled kids, though, and it's a very different story.
There is NOTHING inherent to children with disabilities that makes them better able to handle these changes, which are nearly never based on the preference or convenience of the family, but instead based on acute daily safety considerations or forced on families by administrative process.
Why will we fight to protect "stability of placement" for abled kids but say nothing about the continuous placement destabilization for kids with disabilities?
