A WA appeals court has dismissed a retaliatory defamation lawsuit that targeted a survivor of sexual violence. This ruling sets a powerful precedent that will protect survivors who speak out about their experiences.
Case Update on Carter v. Jones:

A Washington appeals court has dismissed a groundless defamation lawsuit that targeted a survivor of sexual violence. This important ruling protects survivors’ right to speak out.In 2021, a parishioner and employee of a Yakima megachurch publicly alleged that she had been raped by the church’s pastor.

In retaliation, the pastor sued for defamation.Fortunately, the parishioner was able to file an expedited motion to dismiss the pastor’s lawsuit because of Washington’s Uniform Public Expression Protection Act (UPEPA).

This first-in-the-nation law creates a special process to quickly shut down lawsuits that silence public speech.By dismissing the pastor’s lawsuit under UPEPA, the appeals court has set a powerful precedent that will protect future survivors who speak out about their experiences.
