Garnet is absolutely right here. More than that, #SCOTUS has made it clear, over and over again, that it is not going to let states use its "original" jurisdiction to sue other states in contexts in which the underlying question *can* be litigated in the lower federal courts. This is one of those.

When I reached out to the state AGs still in this #disability lawsuit, there was a disconnect. Their spokespeople talked about it as though it were about keeping historical Section 504 protections in place, but the lawsuit had tried to have 504 declared unconstitutional stateline.org/2026/10/02/a...

This piece links to a FB post from Rep. Rod Furniss, who says he's a no on prop 1 and it should be the "No. 1 issue" to address the law and health exceptions/criminal liabilities in January. Which is funny, because Furniss knows firsthand that those bills have gone nowhere for three years now.

Already have a guy in my emails very confidently being wrong about this article, so to be clear — these three Republican-led states have sued three Democratic-led states in the U.S. Supreme Court. The same AGs filed a separate lawsuit in district court against 30 abortion medication providers.
