The tobacco industry has become increasingly worried that the Nicotine Free Generation movement here and in the UK is a real threat to their grotesque business model. So they are escalating their work in opposition, a telling sign that we’re on to something with this reform. Health above profits.

'Corporate Childrearing' is forthcoming in Duke Law Journal (26-27). Corporations play a huge role in children's identity formation. The piece reshapes the family law triangle into a square to make their influence and their intrusion on family relationships explicit. papers.ssrn.com/sol3/papers....

Mahmoud v. Taylor upends the law allowing parents to direct their child’s education by choosing their child’s school, *not* by creating a buffet of content at the public school that parents can choose. Completely misrepresents Yoder precedent.

You can't just be right, you have to know you're right. Good advice for LLMs, according to new Johns Hopkins research. Sometimes no answer is better than a wrong one - life or death choices in medicine, for example, or big financial decisions. 🧵

Laurence Tribe on 28th A: it is now part of the Constitution. Congress’s date is not binding. To be binding, it would need to be in the Amendment text, per S Ct case law known before Congress of 1960s/70s ratified, and Congress chose not to put deadline where it would have power.Celebrate the 28th!

1/2 More people should talk about this: both houses of Congress have passed the ERA, and 38 states have ratified it. That makes it an amendment. Congress has put additional conditions of a time limit on an already absurdly difficult amendment process.

For better or worse, I think New World contracts are here to stay. Given my view that consumer consent is a fiction, contract law should be retooled with this understanding in mind. This means far more guardrails on contracts to address power asymmetries.

Too often techie’s seem to feel that parents are an obstacle to a child’s well-being rather than the party more trustworthy with it than a commercial actor. Wishing tech people would resolve their own parent issues enough to evaluate whether parents or corporations are more self-interested.

“Deliverism” is a bad strategy it turns out? I think you could alternatively read this as saying the Teamsters gave in to their “feels”, but Biden could also have worked a perpetual campaign about his accomplishments. He thought people would get sick of that but he may have been wrong.

I've said this before but will continue to harp on it - even though that's very frustrating for perpetually politically engaged people because it casts them as ultimately powerless - the Democrats don't need to move radically right or left on some issue to satisfy a random pundits hot election takes

The case for embracing Bernie policies is that if we are going to lose either way, why not stand for something. But the claim that this agenda has electoral power? Might be true! But doesn’t become true by repetition. Solid evidence would be helpful.
