Things got more insane just about as soon as I posted this last night. DHS is now arguing that we cannot even put the names of ICE officers in our lawsuit against those officers. Their position is that, if a defendant works for DHS, they cannot be named in a lawsuit. Never seen anything like it.
All this time, while Defendants have refused to identify Does 4 and 5 or respond to Leo’s discovery requests, the six-month statute of limitations on his FTCA claims has nearly expired. So, on October 6, Leo sought Defendants’ consent to file an amended complaint that (1) adds his FTCA claims against the United States and (2) adds the names of Does 1, 2, and 3. These minimal changes are shown in a redline attached to this filing.
Defendants, however, refused to consent to Leo’s amendments because there is not a protective order in place. One of Defendants’ positions with respect to the protective order is that the “full legal names” of all government employees “should be confidential.” (ECF 109, at 2). That position, apparently, means that Defendants even oppose Leo identifying specific officers in his lawsuit against those very officers based on their misconduct in carrying out their public duties. Because Defendants will not consent to Leo’s amendments, Leo has filed this motion for leave.Justice also requires granting Leo leave to name the Doe officers as defendants. Despite DHS’s remarkable position that all government employees’ names are confidential, parties routinely sue government employees by name. In fact, Rule 10(a) “requires a complaint to ‘include the names of all the parties.’” Doe v. Frank, 951 F.2d 320, 322 (11th Cir. 1992) (per curiam) (quoting Fed. R. Civ. P. 10(a)). “Lawsuits are public events.” Id. Rule 10(a) “protects the public’s legitimate interest in knowing all of the facts involved, including the identity of the parties.” Id. Only in an “exceptional case” can a party’s name be withheld from the public. Id. And that bar is even higher for public employees since their employment “diminishes their privacy interests” given “the corresponding public interest in knowing how public employees are performing their jobs.” Stern v. FBI, 737 F.2d 84, 92 (D.C. Cir. 1984);

Color-blind meritocracy was, for many years, a successful rhetorical strategy for undermining antidiscrimination law and excluding Black people from selective schools and prominent positions. That’s why so many former segregationists seemed to suddenly embrace the concept in the 1970s. For them, resegregation—not color-blindness—was always the goal. As long as the success of some immigrants could be used to paint Black students as undeserving, color-blind meritocracy was good. But now many on the right see a new problem: too many Asian Americans in elite spaces. Their success, therefore, must be portrayed as a sinister theft of real (white) Americans’ birthright.

The declining “social trust” that the administration warned against is, of course, not the fault of these students. The problem is bigots like Bo French who cannot accept into their community people who do not share their race and religion, and those who monetize or otherwise profit from that bigotry by spreading it through social media. Like the proverbial child who kills their parents and asks for mercy as an orphan, they are responsible for the problem they are decrying.

Four days before yesterday’s ICE shooting in the Bronx, Judge Gary Brown of EDNY (Trump apptee) listed 7 outrages in an ICE case before him, including evasive & apparently perjurious testimony, post-hoc sworn arrest warrant containing false info, woeful lack of training … 1/2
The evidence points to numerous failings on the part of both ICE and the officers
who testified, including:
1. evasive and apparently perjurious testimony by the ICE agents, including the
testimony concerning supposed observations of the petitioner engaging in drug
transactions, which bear all the hallmarks of coordinated fabrication,12 the absence of any recovered drugs, paraphernalia or cash from the petitioner,
the failure of the agents to follow up upon these supposed observations or refer
the matter to another law enforcement agency, and the notable absence of any
reference to these observations in the voluminous documentary records, further undermining the agents' testimony;
2. the seemingly reflexive, though false, claims that the petitioner was
"misidentified" as the target of the operation;
3. fundamental misconceptions about ICE agents authorities and duties;
4. illegality of the arrest and detention of petitioner and Concepcion;
5. the post-arrest documents, which not only were procedurally and legally
suspect, but contain false statements;Notably, in its filings, Government counsel has not referenced this testimony, seemingly abandoning any argument predicated upon these sworn assertions by the agents.

6. the database search process used to justify the administrative warrant, as
described by the ranking supervisory officer, which appears designed to generate misleading information in official records; and
7. the inexperience of the agents involved, their woeful lack of proper training, understanding of law, policies and procedures, and their ready recourse to false testimony to conceal these failings.

I agree that this is a BFD. But I think it gives Trump too much agency. This was baked in for quite some time and I expect Lindsey Graham's death is what accelerated it. Putin is no doubt offering Trump a way out of his Iran disaster, which ALWAYS required scapegoating Ukraine.

Emphasizing: people I am speaking to are strong and have tremendous spirit. But they have been devastated. They mostly entered the U.S. legally, worked for several years, were detained (frequently illegally), arbitrarily deprived or denied status, treated brutally, and dropped here with nothing.
