BREAKING: Judge Patrick Schiltz in Minnesota threatens criminal contempt, if necessary, to address ICE noncompliance in an order calling out U.S. Attorney Daniel Rosen's response to Schiltz's earlier questions about noncompliance with court orders. "ICE will comply with this Court's orders."
As noted, Rosen asserted in his email that "[t]he lawyers in my civil division
didn't deserve" the supposedly inaccurate January 28 order. Putting aside the fact that
the January 28 order was not inaccurate, Rosen failed to mention that this Court said the
following in the show-cause order that preceded the January 28 order:
The Court expresses its appreciation to attorney Ana Voss and her colleagues [in the civil division], who have struggled mightily to ensure that respondents comply with court orders despite the fact that respondents have failed to provide them with adequate resources.

The judges of this District have been extraordinarily patient with the government
attorneys, recognizing that they have been put in an impossible position by Rosen and
his superiors in the Department of Justice (leading many of those attorneys- including, unfortunately, Ana Voss- to resign). What those attorneys "didn't deserve" was the
Administration sending 3000 ICE agents to Minnesota to detain people without making
any provision for handling the hundreds of lawsuits that were sure to follow.If anything is "beyond the pale," it is ICE's continued violation of the orders of
this Court. Increasingly, this Court has had to resort to using the threat of civil
contempt to force ICE to comply with orders. The Court is not aware of another
occasion in the history of the United States in which a federal court has had to threaten
contempt -again and again and again - to force the United States government to comply
with court orders.

LAWYER CODE OF CONDUCT
An ethics reminder in troubled times

A lawyer, as a member of the legal profession, is a representative of clients, an officer of the legal system and a public citizen having special responsibility for the quality of justice. Lawyers practicing in Minnesota’s state and federal courts must follow the Minnesota Rules of Professional Conduct. The rules protect the public from unethical conduct by lawyers, many of whom hold positions of great power. Given reports of recent events in our state and federal courtrooms, we thought that an overview of key ethical rules might be helpful to the public.

First, a lawyer may not make a frivolous argument, which is an argument made without a good-faith basis in law or fact. This is true even when the lawyer’s client insists on a particular argument or position. “I did what my client wanted” is not a defense to making a frivolous argument. Similarly, a lawyer must disclose legal authority that is directly adverse to the client’s position.

Second, in many cases there is no “just following orders” defense to lawyer misconduct, which can occur even where the lawyer acts at the express direction of another person. The same is true in reverse: A supervisor cannot close their eyes to their staff’s conduct. Instead, the supervisor must make reasonable efforts to ensure that their lawyer and nonlawyer staff follow the ethical rules. Organizations and offices bear a collective responsibility to make sure that their staff follow Minnesota’s ethics rules.Finally, Minnesota’s ethical rules instruct that a lawyer must not engage in conduct that is prejudicial to the administration of justice. This can include ignoring court orders, attempting to influence witness testimony or disparaging parties in a case. Conduct need not be illegal to be deemed prejudicial to the administration of justice and, therefore, unethical.

The vast majority of lawyers in Minnesota ethically represent their clients’ positions. Most aggressive or unpopular actions by lawyers are not unethical. But lawyers who violate our ethical rules put at risk the very basis of our system: the rule of law. Lawyers are bound to uphold the standards of professional conduct, even in extraordinary times.

But the violence he endured last month in Minnesota while being detained is seared into his battered brain.

He remembers Immigration and Customs Enforcement agents pulling him from a friend’s car on Jan. 8 outside a St. Paul shopping center and throwing him to the ground, handcuffing him, then punching him and striking his head with a steel baton. He remembers being dragged into an SUV and taken to a detention facility, where he said he was beaten again.

He also remembers the emergency room and the intense pain from eight skull fractures and five life-threatening brain hemorrhages.

27. I was put in a cold cell where I had to sleep on the bare cement floor. Around 10 in the morning my cellmate asked to speak to an ICE officer. Three officers came into the cell so I had a chance to speak to them too. One officer told me that I "had no chance of returning to Minnesota" and that "the best thing for (me] is self-deportation." She told me that if I fought my case, I would spend two to three more months here in El Paso. She offered me $2600 to self-deport. I refused. I wanted to talk to my attorney. They didn't tell me the judge had already ordered my release and return to Minnesota. If I hadn't managed to talk to my attorney who told me a while back that I was ordered released. I might have given up at this point and signed the self-deportation forms because the conditions were so unbearable.
