As mentioned in my comment on USPS's new ballot rule, the American postal service was born in 1774 _because_ the alternative system (the Crown's post) let the executive decide which mail not to deliver. For a Court riveted by bespoke historical analogs, this rule is 252 years of unAmerican.

INTRODUCTION 

This Article attempts to clarity some of the sources and stakes of Marxist legal theory today. It proceeds in several stages. In Part II, I provide a brief overview of Marx's own engagement with questions of law, rights, and the state in the first volume of Capital, the only volume he completed and saw to publication. Formally educated in law, Marx's abiding interest in legal ideologies, instruments, and institutions is palpable throughout his writings, both published and unpublished. I focus on three portions of the first volume of Capital that are especially important from the perspective of legal and socio-legal theory: the opening chapters, which discuss commodities, labor, money, and value; chapters ten and fifteen, which concern class struggles around the length and intensity of the working day; and chapters twenty-six through thirty-three, which relate
to the origins and presuppositions of capitalist production in and beyond Europe. Capital, I suggest, is under-appreciated for its attentiveness to law's role in capitalist
social relations. In Part III, I show that the complex handling of law in Capital is in keeping with Marx's life-long concern with questions of law, legality, and legal ideology, evidenced as early as his political essays, philosophical studies, and journalistic interventions in
the early to mid-1840s.

Trump is directing the Equal Employment Opportunity Commission to prioritize cases of discrimination against white men, but commission staff are "struggling to find complaints with merit"
Four months later, in early January 2026, the same district director made the instructions more explicit, telling his reports that they should assign the top ranking to all cases claiming discrimination against white people, except those deemed to have major legal shortcomings.

The second email came weeks after Ms. Lucas released a video on social media, encouraging white men to file complaints if they experienced discrimination at work.

The video spurred shock and consternation inside the agency, employees said. In the past, they said, investigators had always pursued cases on behalf of white men when they arose. Singling them out now, at the expense of other groups, seemed to turn the E.E.O.C.’s mission, born of the 1964 Civil Rights Act, on its head.

Now, facing pressure to bring more cases for white men — as well as claims of discrimination against American-born workers and cases of systemic antisemitism — staff in several districts said they were struggling to find complaints with merit. And they said they were pressed by their superiors to look for reasons to keep those cases alive, even when evidence was weak.

The Buckley court was right that threats to free speech and association, and the dangers of incumbency-protecting laws, mean that courts should closely scrutinize campaign money laws. But that should not doom all attempts to level the playing field or limit the risk of corruption from nine-figure campaign contributions, mostly to ostensibly independent groups. If Congress passed a law with generous contribution and spending limits, and strong disclosure rules, we could have ample breathing room for vigorous and competitive campaigns without the danger of the wealthy swamping our democracy.

Because Buckley was a constitutional decision, there are only two paths to overturn it. One is to get a court majority to rethink the case’s fundamental mistakes. With the current makeup of the court, that seems unlikely. An even harder road is to amend the Constitution to allow for a better balance between the rights of free speech and the risks of corruption and oligarchy.

We should not give up the struggle over our money-in-politics rules. But we must recognize that there will be fierce resistance from the moneyed interests who benefit from a system giving them outsize influence over who is elected and what politicians do once they are in office.

A real democracy deserves better than Buckley.
