If nothing else, I think law profs at elite schools face a huge conflict of interest problem, bc they want their students to clerk for SCOTUS, and if SCOTUS is 6-3 GOP, then liberal law profs have to curry their favor. But I also think it's not seeing the stakes for what they REALLY are.

The thesis of Feldman’s article is exactly backward. The primary problem with the Court majority is blind adherence to partisanship, picking and choosing whatever interpretive method gets the desired outcome. If they strictly followed any judicial philosophy our situation would be better.

The current court majority isn’t remotely originalist. The only one of their major conservative decisions on the last several years that is even arguably originalist is Dobbs. The immunity case, the Muslim ban case, all the cases striking down the Voting Rights Act? Not a bit.

In Trump’s first term, he escalated in Afghanistan, bombed Syria, escalated with Iran, and loosened rules of engagement to allow more civilian casualties. Out of office, he said the problem in Gaza was Israel held back too much. But for some reason, “anti-war” types didn’t think that mattered.

In 2016, media was so enthralled by a Republican criticizing George W. Bush for Iraq that they didn’t care that Trump’s criticism was not enough war crimes or resource theft. And when Russia attacked Ukraine in 2022, the push to blame it on America, especially Biden, came from right and far left.

“No NEW wars” was the trick, and I can’t believe people fell for it, but many did (including most media). If Americans have to hear about war in a new location, that is bad and the US president’s fault (Libya, Ukraine). Trump Term 1 worsened Syria, Iran, Yemen, Afghanistan, but that doesn’t count.
