There was a lot of chatter about Sarah Huckabee's ad using a white gamer loser in her ad about "work requirements," but the lede, to me, was that they were about *Medicaid* work requirements. IE, the gamer wasn't getting a welfare check. He just had health care!

DOJ is continuing its equally embarrassing and alarming practice in the second Trump administration of going after federal judges who push back against lawlessness and support the rule of law. Today, they filed a judicial complaint against Minnesota federal judges who spoke to The New York Times.
CONCLUSION
DIS frequently has cases pending in the District of Minnesota, including immigration cases before Judge Schiltz and Judge Tunheim. These judges should be ordered to recuse from any matters involving DHS because the public reasonably questions their impartiality in cases involving immigration. Morcover, the Eighth Circuit should initiate an investigation by the Judicial Counsel into the improper conduct by judges in the District of Minnesota who "covet publicity" rather than adhering to the rule of law by adjudicating cases or controversies. NFL, 585 F.3d at

Yes, the push to adopt the IHRA's definition of anti-semitism has obviously backfired. It defines "drawing comparisons of contemporary Israeli policy to that of the Nazis" as anti-semitism. Therefore, calling Gaza "genocide" is anti-semitism. holocaustremembrance.com/resources/wo...

Yeah. My point is that the successful push for a carve-out in the First Amendment - universities, states, etc, not allowed to boycott Israel - has been a boon to antisemites.

By no means am I defending anti-semitic losers who talk about "ZOG," but the overall ADL project - getting special no-boycott rules for Israel that no other country has an America - has clearly backfired. It's an incredibly useful story for bigots!

Republican memory is an amazing thing. McCormick says Obama "talked about" raising gas prices on purpose. I think that's a reference to a 2008 quote from future Obama Energy Sec. Stephen Chu, which lived on in GOP ads for a decade sec.online.wsj.com/article/SB12...

I think a lot about Biden/Garland keeping David Weiss on as US Attorney, because they didn't want to meddle with the Hunter probe. And then Garland elevating Weiss to special counsel so he could convict Hunter. And this having ZERO IMPACT on the GOP certainty that Biden was rigging the DOJ

It's a fascinating mistake bc it is rooted in the 100% GOP confidence that there was a coordinated legal attack on Trump from Biden/Garland etc. It follows that Smith must have been colluding with Willis to help her out. The idea that he has integrity and wouldn't do that is off the board.

You sometimes encounter a very smart person who just doesn't care about music and thinks about it as background noise while they code or host dinner parties. Jeff Bezos once famously grabbed a bunch of CDs from a convenience store rack for a road trip, not caring or knowing who the artists were.

Gasoline will have a big impact on September CPI. EIA data show Sep YoY gasoline inflation is 36%. Diesel (not a line item in CPI) will be worse, at 68% YoY. (Diesel demand is half of gasoline by volume; shows up more on the PPI side, and/or embedded in inflation of other goods with lag in CPI)

Just a reminder that this is the same Sen. Schmitt who repeatedly claimed that Chief Judge Boasberg was receiving a disproportionate share of Trump-related cases because he confused the D.C. Superior Court (which has 62 judges) with the D.C. district court (which has 15).

I'm not the audience for the Smith hearing, but the main political issue here is that Republicans want the world to know that Smith subpoenaed congressional phone records as he investigated Jan. 6 etc, and nobody outside the Senate can explain to you why that's bad.

OTOH Schmitt is smart enough to just sit there and take the compliment and say "yeah" to something else. What's interesting to me about that clip + Sean Hannity tweeting it is that it seems like his office advanced that he was gonna nail Smith on this to select outlets.

Aaron is not underrating this. It's cinema. The sly smirk when Schmitt thinks he's gotten Smith to perjure himself. The hasty vanishing of the sign. Klobuchar getting Kennedy to hold it up. Schmitt getting LOUD and ANGRY when Klobuchar points out he mixed up the Hawks and Hawkeyes.

Yes, yes we are pushing back.
Publishers Push Back: The NYT, Chicago Tribune, and other publishers are asking a federal judge to disregard the Trump Justice Department’s defense of OpenAI in a landmark copyright case, suggesting the administration may have been influenced by “political and financial interests.” The move came after the DOJ filed a brief earlier this month backing OpenAI’s use of copyrighted news articles to train A.I. models qualifies as “fair use,” arguing that restricting A.I. development could hurt U.S. competitiveness. The publishers countered that the government’s position is separate from the copyright questions before the court. “By all measures, this Statement of Interest appears to be an effort to further enrich the world’s largest companies—and the Administration’s largest donors—while undermining this country’s free press,” a spokesperson for The NYT said in a statement.

And if you're curious as to why stations can be held liable for defamatory claims in third-party ads but *not* in candidate ads, we did an explainer earlier this year! It all goes back (believe it or not) to a Senate race in North Dakota ... in 1956 www.the-downballot.com/p/morning-di...
Normally, broadcasters can be sued for airing defamatory material—even advertising created by others—since stations are regarded as “publishers” of any such advertisements. A 1959 Supreme Court case, however, gave broadcasters immunity when it comes to candidate ads.

Three years earlier, a North Dakota TV and radio station, WDAY, had allowed the Democratic and Republican candidates running for the U.S. Senate to both air speeches shortly before Election Day. An independent candidate, Arthur Townley, then demanded—and received—the same opportunity.

In his address, Townley charged that his rivals “take orders from Communist controlled Democrat Farmers Union” and claimed the organization wanted to “establish a Communist Farmers Union Soviet right here in North Dakota.”

The Farmers Union then sued both Townley and WDAY for defamation, but WDAY argued that because it was obligated to give Townley equal time under the Communications Act, it could not be held liable. The Supreme Court ultimately agreed, setting a nationwide precedent that holds to this day.

(Townley, incidentally, never responded to the lawsuit and won less than 1% of the vote.)
