Having slept on it, I am far more troubled by this settlement. The government should not be able to use its power to bully a defendant into silencing lawful third party speech. That's what the govt did to bookstores in Bantam Books. The Court held that it violated publishers' 1st Amendment rights.

The Meta settlement is as if the censors in Bantam Books had reached a voluntary "settlement" with bookstores, instead of informal compliance. That should still be unconstitutional. Even more so, since it uses *more* state power to suppress lawful information through the courts.

The idea that consenting to TOS may be carte blanche consent for Fourth Amendment (and privacy law) purposes is a giant bomb that would eviscerate our even limited privacy rights in the digital space.
