Roger Marshall’s not saying that the woman accusing him of having her arrested while 8 months pregnant in front of her daughter wasn’t arrested. He appears to be saying she owed a lot more than $50, that the arrest was failing to appear in court re: the debt, not the debt per se, and so on.

Normally, broadcasters can be sued for airing defamatory material—even advertising created by others—since stations are regarded as “publishers” of any such advertisements. A 1959 Supreme Court case, however, gave broadcasters immunity when it comes to candidate ads.

Three years earlier, a North Dakota TV and radio station, WDAY, had allowed the Democratic and Republican candidates running for the U.S. Senate to both air speeches shortly before Election Day. An independent candidate, Arthur Townley, then demanded—and received—the same opportunity.

In his address, Townley charged that his rivals “take orders from Communist controlled Democrat Farmers Union” and claimed the organization wanted to “establish a Communist Farmers Union Soviet right here in North Dakota.”

The Farmers Union then sued both Townley and WDAY for defamation, but WDAY argued that because it was obligated to give Townley equal time under the Communications Act, it could not be held liable. The Supreme Court ultimately agreed, setting a nationwide precedent that holds to this day.

(Townley, incidentally, never responded to the lawsuit and won less than 1% of the vote.)

In theory, Hamilton himself could held be liable for defamation, but even if so—huge, huge "if"—any recompense for Marshall would be years down the road (following extensive, expensive litigation). Most importantly, it would *not* result in the ad getting taken off the air before Election Day.

Oh for gods sake. First, while it’s true that Florida has the highest ACA enrollment in the country, no, there are not "5 x more people enrolled in Obamacare in Florida than live in the state." Around 19% of the total population is enrolled, which is high but hardly over 100%. 1/5th =/= 5x.

I was deputy M.E. at the WSJ when Murdoch took over, with a similar “editorial independence board.” Within 4 months, our top editor was gone, replaced by a loyal Murdoch deputy. That board raised a quivering objection, but the deed was done. If the Ellisons own CNN, they’ll do whatever they want.

Democrats have just 4 senators from states without an international border - Colorado and Nevada. The Iowa / Kansas / Nebraska sudden battlegrounds are doubly interesting - not just for control of the Senate but whether Ds figure out how to win again in the heartland.

When I visited NYC the lack of public bathrooms was a pain. There is a Throne bathroom on the bike path in DC burbs that is great. Solar powered, self cleaning, air conditioned, you don't have to touch anything, real sink. It's nicer than my bathroom at home. And free to anyone with a phone.

my live fuel clock showing Americans now have spent $70 billion more on filling up with gasoline since March 1 (vs same period a yr ago) and $44 billion more on diesel (same dates) for a total of ~$114.2 billion spent over this time.
