For every story like the Cornell gang rape, there are thousands more that couldn’t make it into the light. I wrote about a few dozen of them at one university in On the Wrong Side. The university’s treatment of survivors is eerily similar to what Jane Doe at Cornell experienced.

The main reason you haven’t heard about campus sexual violence in a few years is because Trump and SCOTUS have made it much, much harder for survivors to come forward. You might vaguely remember that Title IX was a big battleground in his first term. And that we lost.

Since then, there has been a good deal of research on racial disparities in Title IX enforcement. No one found anything. (Myself included.) In fact, sexual assault is one of the only school disciplinary proceedings without a racial disparity.

For a very brief period of time, expulsions increased—slightly. At its highest rate, the average school expelled one rapist every three years. When Trump took office and rescinded the Obama era guidance, the expulsion rate dropped back down to zero or near zero.

One of the main critiques at the time was that it didn’t go far enough. Rape was treated as an exceptionally bad form of gender-based violence, but survivors were equally traumatized by sexual harassment, intimate partner violence, stalking, and other forms of sexual assault.

One of the things that shocked me most in my study of campus sexual violence is that so many of the cases were just like this. The evidence was full of confessions. The perpetrators didn’t deny their violence. They just argued they should be allowed to do it and the school agreed.

I think a lot of our good faith critiques were the canary in the coal mine of where we were headed. DEI had been co-opted by institutions hostile to the fundamental mission of DEI. It started to feel like something very different from where it started, but those origins are worth defending.
