Restorative justice also has huge limitations in the context of sexual violence. The perpetrator must confess. There cannot be a structural power disparity between victim and perpetrator. It is not safe for intimate partner violence. It is too time-intensive for victims with multiple perpetrators.

also: a reminder that restorative justice is definitionally within the control of the person who has been harmed and not ANYONE ELSE. it cannot be a route chosen for them, and they have full control over the process. otherwise it’s just sparkling mediation

"But what if he says he's sorry and means it?! Shouldn't there be some way he avoids consequences?" No. If he's sorry and means it, he'll be happy to experience the loss of special privileges which makes people think he's less likely to do it again, and which erodes rapists' feelings of impunity.

I think you are mistaking the absence of a path of no consequences for mob justice. It feels like there's nothing he could do to avoid social consequences ... but that's fine, actually. Rape deserves social consequences.

Somebody changing for the better doesn't mean there shouldn't be consequences for torturing someone for pleasure. Restorative justice isn't about opening up a painless path where no one experiences consequences, it's about trying to find a path where atonement can do good.

Inevitably the discourse turns to "restorative justice," which I think is deeply misunderstood because there is a sort of corporatized version that got copied and pasted as a policy for institutions looking for an easier answer. (Very similar to "anti bias" trainings).

Sure, why not? He can get another job. It's not the end of his life. Most people don't have access to a massive crowd of adoring fans, it's no terrible thing to not have that. Gracefully accepting that there are social consequences for sexual assault is a necessary minimum for being better.

Do you ever think about stuff like how if teeth weren't a thing we wouldn't necessarily know that bone can be secreted in layers like that? And wonder just how many things like that *could* exist in biology which we just don't have examples of? How many ways can bones be made that we've never seen?

I cannot endorse this enough. Unless you've heard/seen the victim's actual story from a recording, you're just reading what some random cop wants the story to be. Often there is zero correlation between the cop's version and the truth.

In case anyone else needs it, the magic phrase for shutting down men picking apart a sexual violence case by blaming victims is: “The only people who would say something like that are rape apologists, rapists, or both.” You don’t have to argue with them on merit when their claims have no merit.

Every single newspaper that reported that Jane Doe “changed her story” should be rushing to publish retractions right now. This case should be a lesson in taking a DA’s victim-blaming statements at face value. Victims do not report to the police because they thought nothing happened to them.

One of the reasons that researchers suspect police react to sexual assault disclosures that way is because the rate of sexual violence perpetration among police is much higher than the general population.

We've already been talking about the systemic mistreatment of sexual assault victims at Cornell. Now, let's talk about New York police. One of the best available insights is into the New York City Police Department who commissioned an independent review of their sexual assault unit in 2021.

The reason cases stalled out is that New York City police only opted to interview 28% of identified suspects. In other words, they had enough information to move forward with a case, but they chose not to do it.

This is the kind of justification schools used for banning my book on campus sexual violence. If we say out loud what they did, they say it’s hurting survivors because no one will trust them enough to report anymore. Silence isn’t a solution. We needed change decades ago.

I've said it before and I'll say it again: US police actively prevent consequences for rapists by hitting victims with a wall of demoralizing hostility and skepticism, and then using their institutional credibility to undermine victim testimony and sabotage evidence and process steps.
