This is good - there were worries that Switzerland, which has pushed back strongly (and very problematically) against the judgment, would manage to get this process closed again as soon as it started. Instead, looks like the Council of Europe and the other States want to see more from Switzerland.

And, of course, the Chamber's approach to KlimaSeniorinnen as established case-law is a breath of fresh air after the debacle of Swiss backlash against the judgment and the Court as a whole. Not that that a Chamber could walk back a Grand Chamber finding if it wanted to - but the tone is refreshing.

By contrast, the remedial finding is very exciting - among other things, the Court orders the State to create a new, independent mechanism to monitor the situation, as well as decontamination strategy and an accessible public information platform.

There's several reasons why this case is interesting - the fact that the Court treated climate change as exceptional, and the victim status/standing criteria therein as inapplicable to other environmental issues, was clear from KlimaSeniorinnen, and so it's low on that list.

Overall, this case is the first in a likely long line of case-law applying KlimaSeniorinnen. It sticks close to the text of the Grand Chamber judgment - as Chambers must do - but it also reveals a Court willing to engage hands-on with systemic environmental issues in a way we haven't seen before.

Judge Serghides also continues to advocate for recognizing the right to a healthy environment through a new protocol to the ECHR - this has been subject to intense debates at the CDDH in recent years. Both judges consider that elements of such a right are already implicit in the Convention.

He cites Katalin Sulyok to argue that there's a legitimacy problem involved in ignoring the scientific evidence underlying a case like this, and shows that the right to life includes a "sub-right to be free from environmental pollution or other environmental hazards that may endanger human life".

Serghides notes that pollution, like climate change, is one of the crises making up the steadily worsening triple planetary crisis, and that the situation in Campania has potentially multigenerational impacts. It also particularly affects vulnerable groups, making it "not unlike" KlimaSeniorinnen.

The second separate opinion is by Judge Serghides, who likewise doesn't think the Court was right to reject representative standing in this case. He puts forth four reasons, arguing that the Court has been too technical and applied KlimaSeniorinnen unreasonably narrowly.
