After listening to oral arguments in Suncor v. Boulder just now, I hope someone will give Justice Kavanaugh my @yalelawjournal.bsky.social Essay on the case. It provides a detailed history of Ouellette & the other precedents invoked in Suncor. These cases do not say what Justice Kavanaugh asserted.

But this isn’t about the merits. It’s about state vs federal jurisdiction. If it gets pushed up to the federal level it will be caught up in the EF legislation which will take forever. So leaving it at the state level will be a faster process - but still…

The thing about the endless stream of nice normal Nazis next door pieces that outlets like the NYT did during Trump 1 especially is that- you gain nothing from them except platforming and normalizing bigotry. They aren’t interesting. Bigots are boring, sniveling mediocre people full of resentment.

New Horizons is now *three days away* from shutting off its two heliophysics instruments, simply because NASA has not provided the $2M in funding it had promised to the mission last year or this year. There is no science basis for shutting these off. Our earlier coverage:

We bought one a year (or two?) ago. No fuss or additional electrical or gas work needed. Super happy with it (fast cooking, cleaner, much better indoor air quality, etc.). Would recommend.

But it's also stupid on its own terms. How much human potential is squandered because potential geniuses/innovators die from preventable diseases/have to work in the fields/don't get an education/etc. in poor countries? I get why rich people fall for this BS, but this is not a serious philosophy.
