The thing you need to understand is that there are 2 (TWO) different method for amending the constitution 1) The process laid out in the constititon itself (conventions, or 2/3's of both houses followed by 3/4 of states ratifying) OR 2) find five votes on the Supreme Court.

That this is descriptively true about how to change the US Constitution as of 2026 is all the evidence you need that judicial supremacy—which makes the Supreme Court the *sole* judge of constitutionality in the political system—is plainly incompatible with constitutionalism & the rule of law as such

Important to remember that the legal profession will never take the lead on Supreme Court reform. Its leaders have too much invested in the notion that the Court is fundamentally Good and Right, and that solving for the real-world consequences of its worst decisions is someone else’s problem.

Telling SCOTUS that Alabama can’t push through its racist maps because it’s too busy honoring Jefferson Davis’s Birthday is perhaps the best thing I’ve ever read. That we’re here because Clarence Thomas ignored Alabama’s request for a SCOTUS decision by this morning is just the cherry on top.
Jeff Elrod, the Director of Elections for Alabama's Secretary of State, testified
at the preliminary injunction hearing on May 22, 2026, that voter reassignments for
the 2023 Plan in Alabama's voter registration database could not begin until May 27
and must be completed by tomorrow, June 2. App. 123, 136-37, 139, 167, 179. In fact, June 2 itself appears to be too late: Mr. Elrod testified, "The vendor has
communicated to us that once the absentee process begins and absentee ballot is issued [sic], that is when the records are locked. The first day for absentee voting for the June 16th runoff is June the 2nd." App. 139. If absentee ballots are issued the
morning of June 2, then all changes must be completed by today, June 1. And state and county administrative offices are closed today, June 1, to celebrate the birthday
of Jefferson Davis. 1 This leaves a few hours on an Alabama holiday to complete voter
reassignment for the 2023 Plan.

My own view is that the central problem with today’s #SCOTUS is the extent to which it isn’t—and doesn’t think it should be—accountable to other government institutions, especially Congress. Today’s “One First” walks through eight of the levers Congress *used* to pull to keep the justices in line:

225. How Congress Used to Leverage the Court
History is replete with examples of Congress using its powers to leverage, nudge, and even threaten the Supreme Court. A big part of how we got to where we are is that Congress has stopped doing so.

Wrote a piece for @slate.com on how our theories of partisan polarization gave the SCOTUS majority more intellectual cover to kill the VRA slate.com/news-and-pol...
The ruling also rests on a methodological error that would earn a failing grade in a graduate statistics course. The court treats race and party as competing explanations, as if controlling for one neutralizes the other. But for millions of American voters, race explains party affiliation.
The vast majority of Black Americans did not randomly sort into the Democratic Party.
Already trending blue since the New Deal, they were pushed fully into the Democratic Party by Barry Goldwater's opposition to the Civil Rights Act and Republicans' Southern Strategy over the decades since. To "control for partisanship" when assessing racial gerrymandering is to erase the very mechanism through which racism travels. Consider the analogy of a court ruling that a company didn't discriminate by gender in pay because, once you control for being a manager or executive-positions from which women were systematically excluded — the gap disappears. Or that if you exclude people with high blood pressure, then a high sodium diet appears to have no effect on your risk of stroke.

FDR’s Fireside chat on March 9, 1937 explaining his proposal to expand the Supreme Court stands up surprisingly well. “We have reached the point as a nation where we must take action to save the Constitution from the Court and the Court from itself.”/1
We have, therefore, reached the point as a nation where we must take action to save the Constitution from the Court and the Court from itself….We want a Supreme Court which will do justice under the Constitution and not over it. In our courts we want a government of laws and not of men.
I want—as all Americans want—an independent judiciary as proposed by the framers of the Constitution. That means a Supreme Court that will enforce the Constitution as writtten, that will refuse to amend the Constitution by the artibrary exercise of judicial power—in other words by judicial say-so. It does not mean a judiciary so independent that it can deny the existence of which which are universally recognized.
