As a pedant, the interesting question here is, how clearly were the terms of the fee arrangement disclosed such that the client’s attempt to kill the lawyer, which resulted in the conclusion of representation, did not then obligate lawyer to return of the balance of the retainer?

My nine year old woke up at six, made a pot of coffee, drank about half of it with ice cream, and after ninety minutes of performing an improvised one woman show with six costume changes, on the themes, mostly, of “David Bowie/why can’t I have a phone/skeletons” made a blanket fort and fell asleep.
