BREAKING: Eleventh Circuit, on a 2-1 vote, upholds injunction blocking Florida from enforcing its 2022 Stop WOKE Act in the university context. The majority opinion is from Judge Britt Grant, a Trump appointee: storage.courtlistener.com/recap/gov.us...
Before GRANT, LAGOA, and WILSON, Circuit Judges.
GRANT, Circuit Judge:
"Congress shall make no law ... abridging the freedom of speech." U.S. Const. amend I. The First Amendment, incorporated against the States in 1868, is this country's written commitment to the idea that freedom of speech is essential to freedom of thought, and that both are essential to maintaining our liberty. The Supreme Court has long been clear that teaching and scholarship are due some measure of protection under the Amendment. But how much? And in what contexts? That Court has not had to say, but this one is now put to the test. The State of Florida legislated a broad set of speech restrictions banning certain viewpoints relating to race, color, sex, and national origin in various settings. The provision at issue here bars Florida's educators from promoting or endorsing those distavored ideas when instructing students. Its prohibition applies not only in primary and secondary education, where states traditionally exercise a great deal of control, but also in public colleges and universities, where the state government's role has been far more limited.
When several groups of professors challenged Florida's new restrictions, the State cast about for an existing case or doctrine that could support its speech ban in the university setting. Finding none, it tried to marry public-employee speech cases with government speech doctrine, resulting in a new rule: if thegovernment pays a professor's salary, it has total control over her classroom speech.
That is not a blessed union. Florida's salary-for-speech rule is a breathtaking assertion of power to ban unpopular ideas from public discourse in the very places the State's own statutes recognize as centers of inquiry-classrooms where students are trusted to puzzle through ideas that are good and bad, easy and hard, ideally getting ever closer to the truth. This new rule also runs headlong into the Supreme Court's repeated, if imprecise, endorsements of academic freedom. If the First Amendment offers any boundary of protection at all for public university classrooms, this statute crosses it.
Nor does this Court's leading academic speech precedent,
Bishop v. Aronov, demand the outcome Florida seeks. 926 F.2d 1066 (11th Cir. 1991). In fact, it counsels the opposite. The restriction in that case was imposed by one university, against one professor, relating to speech about one thing— personal religious views that got in the way of the course's well-understood parameters. That precedent makes clear that universities and even other government entities have crucial authority to shape curricular content, discipline teachers, and take other steps to guide and govern postsecondary education. But the speech ban Florida's political leaders seek to impose here is different in both nature and degree from these ordinary concerns. The rule Florida developed for this case does not withstand scrutiny.
11 Case: 22-13992
Document: 156-1 Date Filed: 07/07/2026 Page:
22-13992
Opinion of the Court
5
The ideas Florida targets may well be noxious. Or maybe
not.
Either way, in this context the First Amendment trusts students to figure it out for themselves. We affirm the district court's preliminary injunction.

Oliver Darcy got the audio of the heated 60 Minutes meeting where Scott Pelley dressed Nick Bilton down! "You know what was rude? Black Thursday. That was the absolute definition of rudeness. Telling Tanya Simon she had to be out of here at five o'clock." www.status.news/p/scott-pell...
"Bari loves this institution," Bilton told staffers at one point during the highly contentious meeting. "She loves '60 Minutes.'"

"She's murdering '60 Minutes,'" Pelley countered. "She does not love this place. She was brought in to kill it—and she's doing exactly that."

This story is based on audio of the meeting obtained by Status. A CBS News spokesperson did not respond to a request for comment, but Pelley's stunning series of remarks left staffers on the newsmagazine wondering if he will resign.

In the meeting, Pelley pointed out that Weiss has "no qualifications for her job" and told Bilton "you have slender qualifications for this job." Pelley, the former anchor of "CBS Evening News," noted that the changes Weiss has made to that program "have been catastrophic."

"So why should we expect any of this is going to be any better?" Pelley asked Bilton.

Bilton tried to move the meeting along, but Pelley pressed on, challenging the new executive producer’s references in interviews to “60 Minutes” creator Don Hewitt’s vision for the program as he outlined his plans.

"I have another question," the veteran journalist said. "Did you at any point work with Don Hewitt, telling everybody about what Don Hewitt thought, and what his inspiration was? I worked for Don Hewitt from 1999 to 2004 and Lesley Stahl probably worked with him for 30 years. Just wondering how you have such deep insight?"

Bilton replied that he was simply quoting Hewitt’s own words from past interviews and asked Pelley whether he had any other questions. Pelley said that he did.

"I have many questions," Pelley responded. "What was wrong with Sharyn Alfonsi?"As Bilton started to say he would "defer," Pelley interrupted: "This is not the crowd to dodge."

Bilton insisted he was not dodging.

"Nobody talked to you about that?" Pelley continued, pressing him on the firing. "They're taking one of your correspondents away and nobody mentioned to you what was wrong with Sharyn?"

Bilton acknowledged that he "had conversations with people."

"And what came out of those conversations?" Pelley asked. "They are private conversations?"

Bilton reiterated that he "did not fire" Alfonsi or Vega. Pelley pointed out that Bilton had nonetheless discussed the matter with others. Charles Forelle, a top Weiss deputy and managing editor of CBS News, interjected, telling Pelley that he was being "rude."

"This is not actually productive," Forelle said. "This is not an interview."

"It's working for me," Pelley replied.

"Anybody came into our house—this is '60 Minutes,'" Pelley added. "I guess you wandered in expecting to read a statement off?"

Pelley then asked Bilton "what was wrong with" Draggan Mihailovich, the executive editor of "60 Minutes" who was fired on Thursday.

Bilton again said that he did not fire Mihailovich. Forelle one more told Pelley that he was being "rude."

Pelley did not let up, however. The veteran newsman told Bilton and Forelle that the way management handled the firings was "cruel." Forelle—yet again—responded by calling Pelley "rude."

"I'm not being rude," Pelley shot back. "I have some pretty—you know what was rude? Black Thursday. That was the absolute definition of rudeness. Telling Tanya Simon she had to be out of here at five o'clock. Sending Draggan Mihailovich to HR to get fired, because nobody could look him in the eye. Not talking about Tanya's contract. Not talking about Sharyn Alfonsi's contract. Not talking about Cecilia Vega's contract. Just calling them up and telling they were fired. That's rude. This is a conversation. That is rude, and you were part of that."

Budgets force us to prioritize at the margins, to determine where to use our limited resources. As a result, they reflect our values. Government is supposed to invest in future wellbeing and to ameliorate current suffering. And while life is unfair, and we will never be able to fix that, the role of government is to help make life less unfair so that struggling people can get by and even have a decent chance to get ahead. The president's budget request instead imagines an America that does less for struggling Americans. A

On 2 April 2025, Trump invited the far-right influencer Laura Loomer into the Oval Office to unveil a dossier depicting staff experts of the national security council as treasonous to Trump. Vice-President Vance, chief of staff Susie Wiles, secretary of commerce Howard Lutnick, and other officials stood by. “You don’t want to be Loomered,” Trump said. “If you’re Loomered, you’re in deep trouble. That’s the end of your career in a sense. Thanks, Laura.” She played the Queen of Hearts in Alice in Wonderland: “Off with their heads!”

Six experts were summarily fired, including Nate Swanson, the senior adviser on the NSC on Iran. On the eve of Trump’s war, Swanson wrote articles for Foreign Affairs and the Atlantic Council warning about the closing of the strait of Hormuz and that “Iran may seriously consider targeting the Gulf Arab states’ energy infrastructure directly.”
