“But the more the justices are going out on hagiographic public speaking tours, the harder it is, in my view, to claim that they must nevertheless be protected against public criticism—even if many of them have leaned into the public celebrity role more than the Chief Justice has.”

Latest: I wrote about internal ICE reviews---now deleted from ICE's website---revealing new details medical neglect in detention centers. The reports contradict DHS' public statements both generally and specifically about in-custody deaths reason.com/2026/10/01/i...
According to the internal report on Blaise's death, "A mortality review committee (MRC) determined BTC did not provide Ms. BLAISE medical care within the safe limits of practice."

The MRC found that, after Blaise collapsed, "1) BTC health staff deviated from basic life support (BLS) protocols; 2) Health staff failed to initiate cardiopulmonary resuscitation (CPR), despite Ms. BLAISE's pulselessness; and 3) Health staff did not include Ms. BLAISE's vital signs with their documentation of the emergency response."

The mortality report contradicts the public report ICE published on Blaise's death, which claimed that staff called for emergency medical services (EMS) and "immediately began cardiopulmonary resuscitation" and "continued providing CPR until EMS personnel arrived."

Not just impeachable. Impeachment, both pres. and agency heads, is the only option. It's impeachment or nothing. Courts won't stop it. Other tools are impotent. Put them on trial the only way you can. Even if you can't get 2/3, use process as punishment. Make it miserable and costly. It can be done.

One telling subplot of how senators (unlike J6ers or Trump or literally anyone else) are obsessed with this phone records subpoena is it never even occurs to them there is an actual broader policy debate re: privacy and how this process works. It’s just about how they’re special so how dare you.

Here's a graphic that does a better job of conveying the point than my original post: even by the (insane) standards of the first Trump administration, #SCOTUS is receiving—and granting—a truly unprecedented number of applications for emergency relief from the federal government:
A chart that shows the number of emergency applications filed and granted by the Supreme Court during each presidency dating back to George W. Bush, with the data annualized to show the far-higher frequencies since 2017, but especially during the Trump I and Trump II administrations.

Doomerism, properly speaking, is insisting he'll win and it's all futile when there are still many reasons to doubt that. That there's no limit to what he might *try* to do is just cold hard objective reality. After Jan 6, no argument along the lines of "he wouldn't go that far" has any credibility.

I don't like having to do this, but I have to. This is not what happened. What happened was that a handful of scholars tried to legitimate an ahistorical argument and were criticized because of it. They then spent a year engaging in abject sophistry and caricaturing their critics. They still lost.
Just after the 5-4 decision in Trump v. Barbara earlier this year, a concerted social-media push cast a small group of originalist scholars as arch-villains for “normalizing” the view taken by three of the justices—namely, that the Constitution does not require a policy of universal birthright citizenship. For some, universal birthright citizenship is so sacrosanct that any disagreement or debate is unacceptable. The only reason the question was remotely in doubt was that originalists sold their methodology for partisan gain.

SCOTUS doesn't like it because they got out their ouija board and peered into the secret hidden meanings of the phrase "case or controversy"? Add it to the much larger pile of reasons having constitutional government and leaving the Roberts Court in place are mutually exclusive options.

Religious conservatives, including the majority on SCOTUS insist that if government does not include religious action, it is a persecution of religion. But as Micah has expertly written elsewhere, permission to treat religion distinctly varies with whatever religious conservatives want policy wise.

As I explained the last time this dumb argument made the rounds, if Congress was never allowed to change the Court’s size (something it’s done seven times), that would mean four of the *current* justices (all of whom are Republicans) hold unconstitutionally created seats: www.ms.now/opinion/repu...
ms.now
Republicans say court packing is 'unconstitutional.' They're wrong.
The argument that court expansion is unconstitutional is weak, transparently political — and most importantly, wrong.
