AI boosters like to tell artists to take action on their own if they want to resist unauthorized data scraping, including things like opt-outs. Here, artist Jingna Zhang created her own site for photographers who didn’t want their works used to train AI, & it still failed. It stinks…consent matters!

If Thaler (Thaler v Perlmutter) had won his Creativity Machine's output being transferred to him under a "work for hire" legal fiction, then the, "I am the creative director" argument from AI gen advocates would be redundant, and they'd stop the disingenuous charade of pretending to be artists.

👨‍⚖️ TL;DR: AI doesn't need to write high-quality books for non-AI book writers to get hurt. Cheap books at massive volume are enough and they've cut what the average human-written book earns in most genres and pushed human titles down the bestseller ranks. (10/n)

There is a known paradox in such rulings (Bartz/Kadrey paradox) at the moment which means that eventually in future cases AI training will be seen as incompatible with fair use. If the utility of the system is to replace humans then that also causes market harm. Thus negating the utility defense.

Ask Google "what is your opinion of Dante's treatment of Ulysses in the Inferno" If you try to claim the answer as your own expression then you are delusional. (Apophenia). If you recognize that the AI is collecting data from the Internet then you are not delusional. Many fall for the former.

Putting one's own © work through AI Gen results in an "author-less" derivative work that cannot have a "point of attachment of copyright" to any author!! This is why copyright owners should NOT be using AI Gen as it could be seen as an "overt act" to abandon copyright in the derivative work.
