Even if tech companies prevail on "fair use" that does not help end users. It means businesses and the public have to make their own individual "fair use" defenses when they are sued. They cannot rely on tech firms cases directly. It means publishers won't deal with AI content as a result.

You cannot use AI (LLM) to do a 'clean room implementation'. It's a defense to copyright infringement based on a human never seeing the product being reproduced and that "same human" being the author of the newly written code. Getting an LLM to do it is not "authorship" so the defense fails.

The "opt-out" of Machine Learning does not exist as any option in the law and there has NEVER been any Machine Learning exception ever in copyright law. Machines are machines. Copyright law was never meant for machines. It was meant for "authors" who are "natural humans".

UK §9(3) does NOT grant copyright to AI gen users (There is no case law of it ever happening). The current consensus is to have that section repealed. In any case is is superseded by Navitaire v Easyjet (2004). The UK has many laws that are ignored, such as it being illegal to be drunk in a pub!

Midjourney: Report Claims AI Model Is Worst Offender For Flouting Hollywood Copyright
EXCLUSIVE: Disney and NBCUniversal accused Midjourney of being a “bottomless pit of plagiarism” in a lawsuit last year. More than 18 months on, the company has allegedly failed to clean up its act. VN.ai, a tech startup that stress tests generative artificial intelligence tools for copyright infringement, has produced its first quarterly report examining how […]

You have no education on copyright law and you are woefully wrong. The wording of the statue says to "prepare" a derivative is the exclusive right of the copyright owner. Maybe check the statute rather than "vibe" the law.

Fair use id just a US doctrine. It doesn't exist in the rest of the world. (See GEMA v Suno). Also USCO's guidelines (3rd AI report) say that most AI training is not fair use.

It is normal for the copyright office to correspond. I had an issue with my registration about claiming authorship of my own 3D animation work for a film > in actual litigation against Valve Corp. Valve requested an investigation and tried to get my registration cancelled but USCO sided with me.

Lol. are you using ai to "fact check"? I'm well aware of what the law is thanks. Unlike you I have actual experience in such things. You are just a loud moth on the Internet spouting nonsense to your own reflection on a computer screen. You have no credibility. None.

TrevBaylis - "Deus Ex Machina baby!" @trevbaylis.bsky.social · 03/10/2026
Er, YES! That is the future being proposed. You will have to pay to use AI generation software to create - works that cannot be protected by copyright (Thaler v Perlmutter). So that is what you are advocating for. A future where tech corps allow your to generate stuff o long as you pay them.

TrevBaylis - "Deus Ex Machina baby!" @trevbaylis.bsky.social · 03/10/2026
If you knew about © law litigation (you obviously don't) you would know that ignoring a public notice means "willful infringement" which raises statutory damages to up to $150,000 for each infringed work.

You probably don't want a future where culture, arts and science are part of a AI tech firms corporate monopoly only available to the public by a subscription fee. A tech firm prevailing over Fair use doesn't mean end users are also prevailing.

YOU are misinterpreting the judgment moron! The main argument in all the cases is that AIgen firms are not actually paying for the material they are acquiring in the first place and just taking it for free. How would you read a book with acquiring somehow it first? (JFHC)
200
TrevBaylis - "Deus Ex Machina baby!" @trevbaylis.bsky.social · 03/10/2026
Anthropic lost that case though. They have to pay $1.5BILLION in damages. You are ignoring the illegal acquisition of books which happens before the training stage. If you go to a bookshop and steal a book your excuse cannot be that you were "just reading it". Use some common sense.

To clarify, under Anderson v Stallone, even non-infringing parts do not "lawfully" acquire § 106(2) (exclusive derivative rights). Without an affirmative licensing agreement that transfers a chain of title from the original © holders, an edited AI output can never be an "exclusive" derivative work.
011
TrevBaylis - "Deus Ex Machina baby!" @trevbaylis.bsky.social · 28/09/2026
There's another problem. "Fair use" is not a grant of exclusive rights under § 204(a). It means all AI gen outputs have no "lawful" chain of title to have "exclusive rights" passed downstream. That means even edited AI gen outputs don't get protection under § 106(2) due to § 103(a).

100
TrevBaylis - "Deus Ex Machina baby!" @trevbaylis.bsky.social · 26/09/2026
Well, Register Shira Perlmutter got sacked (courts reinstated her) for pushback because of the training data issue not being fair use in most cases (USCO 3rd Rrpt on AI). It means that even edited AI gen outputs would lack protection under §103(a). That is likely how the courts will eventually rule.
000
TrevBaylis - "Deus Ex Machina baby!" @trevbaylis.bsky.social · 26/09/2026
There are no AI rulings from the courts saying that AI assisted works are protect-able. Thaler v Perlmutter is settled but Allen v Perlmutter and Suryast v Perlmutter are ongoing. My guess is the courts will rule against giving AI gen assisted works protection because of training data issues.

I disagree. If AI wanted to license my work it would have to pay me enough that I would not have to work again. AI licensing means that exponential amounts of derivative works could be made of my work which makes me obsolete. That's going to have to be factored into any licensing deal I would make.

wouldn’t it also make sense for those LLMs to belong to the public and governed to promote the common good of the people? That is actually an argument against LLMs because they replace people with a *tech corps monopoly of arts and science* leading to a reliance on that tech corp monopoly.
