New: We obtained witness videos and surveillance footage showing ICE parking their cars, arresting an observer, and transferring detainees in parking lots across 4 of Chicago's police districts. Local officials have tried banning ICE from city property. But incidents in the lots keep stacking up:

TLDR, got to this part and stopped "Only 0.04% of America’s freshwater in 2023 was consumed inside data centers themselves. This is 3% of the water consumed by the American golf industry." If you limit the effects of something to try and explain away the totality of the effects, that's a problem.

We write as governors committed to the effective administration of our Medicaid programs on behalf of the millions of Americans who depend on them. As our states work diligently to implement the Medicaid work
reporting requirements on the ambitious timeline set forth in H.R. 1, we are writing today to respectfully seek the federal partnership necessary to ensure responsible implementation.
Specifically, we request two things: first, we request that your department confirm that, should the forthcoming Interim Final Rule (IFR) introduce substantive policy changes that diverge from states’ reasonable working assumptions, an appropriate timeline is afforded states to make these significant policy and technology changes;
and, second, we request that your department provide a formal written response to our outstanding guidance requests before June 1, 2026, to support timely state planning.

The Implementation Challenge

Our concern is straightforward: our states are working diligently to implement the Medicaid work reporting requirements enacted by Congress last summer, and we have done so with limited federal guidance. In the ten months since enactment, we have reached out to your department on multiple occasions seeking operational
guidance, and while CMS has provided helpful verbal assurances, we have not yet received formal policies. In the absence of final official guidance, and in service of the challenging timeline set out in the law, we have made good-faith operational decisions to revise our state systems. We write today requesting that published, final guidance align as closely as possible with states’ working assumptions based on informal policy direction from CMS to date and that states not be required to make significant changes at this stage of implementation.

States must make substantial changes to their eligibility and enrollment systems; de…We understand that CMS is required to publish an IFR by June 1, 2026, and we appreciate the Department’s
efforts to meet that statutory deadline. However, the timing of the IFR in relation to the January 1, 2027 effective
date creates an operational challenge worth addressing now. If the IFR contains policy guidance that differs in any
material respect from the operational choices states have made – whether in the absence of CMS guidance or in
reliance on the verbal communications CMS has provided – states may need to revise or revisit significantSecretary Kennedy

portions of their implementation work. Given the timing, that would leave states seven months or less to finalize
regulations, update systems, execute data-sharing agreements, issue beneficiary notices, and complete all other
required steps before the January 1 compliance date.
This challenge is compounded by a structural reality of Medicaid administration that CMS understands well:
many states do not build or maintain their own IT systems. These systems are built, maintained, and modified by
third-party vendors operating under multi-year contracts representing tens – and in many cases hundreds – of
millions of dollars in state and federal expenditures. Every change must be specified in writing, scoped and
contracted with the vendor, reviewed for compliance with federal certification standards, independently tested,
and validated before deployment. Vendors typically require six to twelve months or more to complete significant
system modifications, even when states provide complete and final specifications from the outset. States are not in
a position to direct their vendors to implement requirements that have not yet been defined.mplementation Timelines Matter for the People This Policy Is Meant to Serve

The administrative record from prior state community engagement pilots offers useful context. When Arkansas implemented similar requirements in 2018, a significant number of eligible beneficiaries lost coverage due to implementation challenges, i.e., system errors, notices that did not reach beneficiaries, and confusion about reporting procedures. Federal courts applying the APA’s “arbitrary and capricious” standard subsequently found that beneficiaries’ due process rights had been affected not by the policy itself but by gaps in implementation
infrastructure and notice – a risk that is meaningfully greater in a simultaneous national rollout undertaken without final federal guidance.
States also face real legal and financial exposure when implementation difficulties result in coverage terminations that are later found to be erroneous. Federal law and the laws of many states entitle Medicaid beneficiaries to restoration of coverage and, in many jurisdictions, to compensation for costs incurred during periods of erroneous
disenrollment. In the absence of a final federal regulatory standard, terminations will necessarily be made in reliance on states’ reasonable interpretations of the statute – interpretations that may later be second-guessed. The financial and administrative costs of responding to beneficiary claims, including any remediation required, are
substantial and fall on state agencies that are already managing significant fiscal pressures.

We raise these concerns because we believe addressing them now is in everyone’s interest. We are asking for the federal partnership that responsible implementation requires – specifically, appropriate transition timelines for any substantive IFR changes and a written response to our outstanding guidance requests by June 1, 2026.
