If New York, Massachusetts, and California had
erected laws encouraging their residents to ship fenta-
nyl or anthrax to addresses in Plaintiff States, there is

protect unborn babies from the moment of conception.

At the same time, LA, AR, and AL *are actively suing* a host of shield law providers in several states in federal court in Louisiana. That is an active case; the Supreme Court case is theoretical.

As usual, seeing a lot of misleading headlines about this news. LA, AR, & AL are asking the Supreme Court *for permission* to sue NY, MA, and CA over their shield laws. Just like when someone appeals a lower court ruling to the Supreme Court, the Court has to agree to take the case. They might not.

Garnet is absolutely right here. More than that, #SCOTUS has made it clear, over and over again, that it is not going to let states use its "original" jurisdiction to sue other states in contexts in which the underlying question *can* be litigated in the lower federal courts. This is one of those.

The law isn’t helping. New York’s voluntary intoxication loophole makes it nearly impossible for survivors to seek justice if they drank or used substances prior to an assault. Because of this loophole, Jane Doe’s assailants may never be held accountable under the law.
