An extraordinary document. Read it. “Attached to this order is an appendix that identifies 96 court orders that ICE has violated in 74 cases. … ICE has likely violated more court orders in January 2026 than some federal agencies have violated in their entire existence.”
On January 8, 2026, petitioner Juan T.R. filed a petition for a writ of habeas corpus.' The Court issued an order requiring respondents to file an answer no later
than January 12, 2026. See 28 U.S.C. § 2243 (requiring judges to either "forthwith award
the writ" or order the respondent to show cause, within three days, why the writ should not be granted).Respondents failed to answer. Accordingly, the Court granted the writ in part
and ordered respondents to afford Juan a bond hearing within seven days or, failing
that, to immediately release him from detention. ECF No. 4.
Respondents neither held a bond hearing within the required time nor released
Juan. ECF No. 6. The Court then issued a show-cause order and scheduled a hearing at
which it ordered the personal appearance of Todd Lyons, Acting Director of U.S.
Immigration and Customs Enforcement (ICE"). ECF No. 7. The Court noted,
however, that if the parties filed a stipulation indicating that Juan had been released, the
Court would cancel the hearing and would not require Lyons to appear. Id. The parties
have now filed such a stipulation (ECF No. 9), and thus, as promised, the Court will
cancel the hearing, and Lyons will not be required to appear.
That does not end the Court's concerns, however. Attached to this order is an
appendix that identifies 96 court orders that ICE has violated in 74 cases. The extent of
ICE's noncompliance is almost certainly substantially understated. This list is confined
to orders issued since January 1, 2026, and the list was hurriedly compiled by
extraordinarily busy judges. Undoubtedly, mistakes were made, and orders that
should have appeared on this list were omitted.
This list should give pause to anyone —no matter his or her political
beliefs— who cares about the rule of law. ICE has likely violated more court orders inJanuary 2026 than some federal agencies have violated in their entire existence. The
Court warns ICE that future noncompliance with court orders may result in future
show-cause orders requiring the personal appearances of Lyons or other government
officials. ICE is not a law unto itself. ICE has every right to challenge the orders of this
Court, but, like any litigant, ICE must follow those orders unless and until they are
overturned or vacated
Juan asks that the Court schedule a hearing at which he may present evidence
and argument concerning the hardships that he has suffered as a result of respondents'
failure to abide by the January 14 order. See In re Tetracycline Cases, 927 F.2d 411, 413
(8th Cir. 1991) ("Civil contempt sanctions may be imposed for either or both of two
distinct purposes, to coerce compliance with a court order, and to compensate the
complainant for actual losses sustained by him as a result of the defendants'
contumacy." (quoting In re Chase & Sanborn Corp., 872 F.2d 397, 400-01 (11th Cir.1989))).
The Court will not schedule a hearing at this time. If Juan wants to seek monetary
sanctions, he may file a properly supported motion to that effect.
ORDER
Based on the foregoing, and on all of the files, records, and proceedings herein,
IT IS HEREBY ORDERED THAT the hearing currently scheduled for Friday, January
30, 2026, at 1:00 pm in Courtroom 15 (MPLS) is CANCELED.

Clemente, who got used to being slapped with labels throughout his life and who came from a place that has lived in a colonialized limbo for over a century now, didn't pause a moment to consider whether the people affected by a disaster thousands of miles away were within his required circle of empathy or help. He took action, with conviction, because those people were worth as much to him as he himself was.

We haven't resolved the colonial status of Puerto Rico in any satisfactory way, and life there gets more precarious by the year, as economic forces and climate change conspire against it. We also haven't resolved the sense of twice-baked alienation Clemente so often felt early in his baseball career. Preferring to read the direction of the wind and blow with it, the Commissioner's Office has abdicated any responsibility to address either issue.

It can't be that way, for those of us who care a bit more about the game and the world it's played in than do Rob Manfred and his cohort. The history of American influence (sometimes imperialist, sometimes colonialist, sometimes covert, sometimes salutary, sometimes calamitous) in Puerto Rico, the Dominican Republic, Cuba, Venezuela and other places is inextricably connected to the growth and development of baseball. In a sport awash in Spanish speakers and immigrants and supported by no small number of people who sound and look like those players, baseball has a huge, urgent duty to speak up each September—not just about the virtue of a great throwing arm and mission work, but about the relationship between the U.S. and many of its neighbors, and about how wide our circles of empathy ought to sweep. The league doesn't want that conversation right now, so please, start it yourselves. Otherwise, we'll be paying just two-thirds tribute to the legacy of Clemente—and letting too much water flow under the bridge.

The Education Department’s civil rights office once helped push a South Dakota school district to treat its Native students equally. Under Trump, that same office decided that helping Indigenous students would discriminate against white students: propub.li/3GIdTRr
Article excerpt: ...an investigation found that the district’s Native American students were disciplined far more harshly than white ones. They also were kept from enrolling in advanced courses.

The OCR said that when speaking with an investigator, the superintendent of schools at the time said that Native American students in her district had higher truancy rates because they operated on what she termed “Indian Time.” She said, too, that they don’t value education, according to the investigation’s findings.

The former superintendent, Nicole Swigart, denied saying any of that.

“I recognize those comments are horrendous,” Swigart said in an interview with ProPublica. She noted that the OCR investigation was opened in 2010 and that she first spoke to an investigator in 2022. “I’m not lying when I say I didn’t say it. I didn’t say it, and I don’t know where it came from.”Article excerpt: In the agreement with the OCR, the district promised to examine its practices and make things right; the OCR would monitor its progress. The district also brought in a new superintendent.

But last month, the OCR abruptly terminated that agreement, based on its differing interpretation of civil rights law. The OCR’s new view is that equity and diversity efforts discriminate against white students. It was, in the view of agency attorneys, the most severe breach of the OCR’s mission and methods to date. There was no public announcement.

“Native students in Rapid City just lost a layer of protection,” the Lakota People’s Law Project announced on Facebook. “Native students are still being pushed out of classrooms and denied opportunities.”

Darren Thompson, who is Ojibwe, said the OCR’s decision to abandon the agreement was “another cycle of the federal government failing to uphold its promises.”

🚨🚨 Deranged letter from Education Secretary Linda McMahon to Harvard’s president, cutting off federal funding for any new grants. Worth reading in full. It is NUTS.
THE SECRETARY OF EDUCATION
WASHINGTON, DC 20202
May 5, 2025
Dr. Alan Garber
Office of the President
Harvard University
Massachusetts Hall
Cambridge, MA 02138
Dr. Garber,
The Federal Government has a sacred responsibility to be a wise and important steward of American taxpayer dollars. Harvard University, despite amassing a largely tax-free $53.2 billion dollar endowment (larger than the GDP of 100 countries), receives billions of dollars of taxpayer largess each year. Receiving such taxpayer funds is a privilege, not a right. Yet instead of using these funds to advance the education of its students, Harvard is engaging in a systemic pattern of violating federal law. Where do many of these "students" come from, who are they, how do they get into Harvard, or even into our country—and why is there so much HATE? These are questions that must be answered, among many more, but the biggest question of all is, why will Harvard not give straightforward answers to the American public?
Harvard University has made a mockery of this country's higher education system. It has invited foreign students, who engage in violent behavior and show contempt for the United States of America, to its campus. In every way, Harvard has failed to abide by its legal obligations, its ethical and fiduciary duties, its transparency responsibilities, and any semblance of academic rigor. It had scrapped standardized testing requirements and a normalized grading system. This year Harvard was forced to adopt an embarrassing "remedial math" program for undergraduates.
Why is it, we ask, that Harvard has to teach simple and basic mathematics, when it is supposedly so hard to get into this "acclaimed university"? Who is getting in under such a low standard when others, with fabulous grades and a great understanding of the highest levels of mathematics, are being rejected?
Harvard has even been embroiled in humiliating plagiarism scandals, exposed clearly and plainly in the media, with respect to your then…running the institution in a totally chaotic way. Harvard alumnus and highly successful hedge fund manager Bill Ackman noted that, under her leadership, Harvard has become "a political advocacy organization for one party."
Ackman has called for the resignation of Pritzker, concluding that the "[t)he mismanagement here is Penny Pritzker" and noting that any serious corporation would have removed her after a litany of recent failings and the fact that, incredibly, "Harvard is not in a good financial position." According to Ackman, one of the world's foremost finance experts, Harvard's so-called S53 billion endowment is "massively overstated as far as what it's really worth," and Harvard has irresponsibly taken out $8 billion in debt.
If this is true, it is concerning evidence of Harvard's disastrous mismanagement, indicating an urgent need for massive reform-not continued taxpayer investment. If Harvard prefers not to change, then Harvard should have no problem using its overflowing endowment to fund its bloated bureaucracy.
At its best, a university should fulfill the highest ideals of our Nation, and enlighten the thousands of hopeful students who walk through its magnificent gates. But Harvard has betrayed this ideal.
Perhaps most alarmingly, Harvard has failed to abide by the United States Supreme Court's ruling demanding that it end its racial preferencing, and continues to engage in ugly racism in its undergraduate and graduate schools, and even within the Harvard Law Review itself. Our universities should be bastions of merit that reward and celebrate excellence and achievement.
They should not be incubators of discrimination that encourage resentment and instill grievance and racism into our wonderful young Americans.
The above concerns are only a fraction of the long list of Harvard's consistent violations of its own legal duties. Given these and other concerning allegations, this letter is to inform you that Harvard should no longer seek GRANTS from the fede…Federal Agencies. The Administration's priorities have not changed and today's letter marks the end of new grants for the University.
These requests will advance the best interests of Harvard University, so it can reclaim its status as a respected educational institution for the future leaders of America. Thank you for your attention to this matter!
Sincerely,
Linda E. McMahon
Secretary of Education
