More to come on this; the rule makes a number of other changes to the Board of Immigration Appeals process (such that it will exist should this rule go into effect in 30 days without a court order blocking it). But top line; it's quite bad! public-inspection.federalregister.gov/2026-02326.pdf

CORRECTION: This rule does not go into effect tomorrow, it goes into effect 30 days after tomorrow. My apology.
DEPARTMENT OF JUSTICE Executive Office for Immigration Review 8 CFR Parts 1003, 1208, and 1240 [Docket No. EOIR-26-AB37; Dir. Order No. 02-2026] RIN 1125-AB37 Appellate Procedures for the Board of Immigration Appeals AGENCY: Executive Office for Immigration Review (“EOIR”), Department of Justice. ACTION: Interim final rule; request for comments. SUMMARY: This interim final rule (“IFR”) amends Department of Justice (“Department” or “DOJ”) regulations to streamline administrative appellate review by the Board of Immigration Appeals (“Board” or “BIA”) of decisions by Immigration Judges by making review of such decisions on the merits discretionary, by setting appropriate times for briefing in cases that are reviewed on the merits, and by streamlining other aspects of the appellate process to ensure timely adjudications and avoid adding to the already sizeable backlog at the Board. Additionally, the Department is making various technical and non-substantive changes to its regulations. DATES: Effective date: This IFR is effective [INSERT DATE 30 DAYS AFTER PUBLICATION IN THE FEDERAL REGISTER]

The appeal to the federal circuit court ALSO costs $600. So now anyone who loses in immigration has to pay $1,000 to be automatically denied in nearly every case, and then $600 to seek an emergency stay of their imminent deportation. AND THIS APPLIES EVEN TO PEOPLE IN DETENTION.

The goal is clear; mass deportations over due process. An order of removal does not become "final" until the Board of Immigration Appeals denies an appeal. After that, ICE can deport the person unless they file ANOTHER appeal to a federal circuit court AND get an emergency stay.

The Trump admin is ALSO changing the rules so that rather than 30 days to file a Notice of Appeal, people will now only have 10 days (in most cases). That's just 10 days to find $1,000 and appellate counsel for an appeal the government says it will likely automatically deny!
The IFR will also change the deadline for filing an appeal with the Board from 30 to 10 days, except for cases involving certain asylum applications, as discussed in more detail in Section IV.B of this preamble. And, as explained in Sections IV.C and D of this preamble, the IFR adopts other measures previously adopted by the 2020 Appellate Procedures Final Rule, which were never fully operationalized, to streamline the processes for obtaining the parties’ briefs and assembling the record on appeal.

🚨HOLY CRAP. The Trump admin just took a SLEDGEHAMMER to due process, largely eliminating the Board of Immigration Appeals process and MANDATING DISMISSAL of ALL appeals (which cost $1,000 thanks to OBBBA) filed after tomorrow unless a majority of the BIA votes to hear the case.
Thus, rather than require such adjudications, the Department is changing its regulations to provide the Board more flexibility in reviewing appeals. Instead, for appeals taken from decisions issued after this IF becomes effective, as explained in
Section IV.A of this preamble, the default will be summary dismissal unless a majority of current Board members vote to consider the appeal on the merits. And such dismissals
will occur quickly—within 15 days of filing the appeal—allowing aliens to seek Federal court review expeditiously, rather than potentially waiting for years for a Board decision that in the vast majority of cases would affirm the underlying Immigration Judge
decision.

🚨HOLY CRAP. An ICE whistleblower just revealed a secret memo authorizing ICE officers to break into homes without a judicial warrant, which DHS's own legal training materials say is unconstitutional! ICE then hid the memo from the public, passing it along by word of mouth and private conversation.
The Gravamen of the Disclosure

4. The gravamen of the disclosure is as follows:
a. By memorandum dated May 12, 2025 (“the May 12 Memo”), Acting ICE Director Todd Lyons authorizes ICE agents to forcibly enter into certain people’s homes without a judicial warrant, consent, or an emergency.

b. Specifically, in the May 12 Memo, the Acting ICE Director authorized ICE Agents to rely on Form I-205 (which is not a judicial warrant) to enter the residence of an alien subject to a final order of deportation, without consent, including by “a necessary and reasonable amount of force.”2c. While addressed to “All ICE Personnel,” in practice the May 12 Memo has not been formally distributed to all personnel. Instead, the May 12 Memo has been provided to select DHS officials who are then directed to verbally brief the new policy for action. Those supervisors then show the Memo to some employees, like our clients, and direct them to read the Memo and return it to the supervisor.

Democrats can retaliate against these GOP gerrymanders with new maps in Illinois, Maryland, Oregon, & Virginia. They could flip 7 GOP seats to make up for this & new GOP maps in Missouri, North Carolina, Ohio, & possibly soon Indiana. Imposing costs is the only way to deter the GOP from doing this
Map of a hypothetical Democratic gerrymander of Illinois' congressional map designed to turn the current 14-3 majority into a 15-2 majority in 2026. The districts are colored by the 2024 presidential winner's margin, with Harris in blue and Trump in red. The blue districts sprawl like pasta noodles across the northern half of the state to redistribute heavily blue parts of the Chicago area and use them to outvote heavily red rural areas.

An accompanying chart shows that 15 districts would be securely blue while just two would be overwhelmingly red. The 1st, 2nd, and 7th districts would be predominantly Black, the 4th district would be majority Latino, and the 3rd district would be plurality white and 37% Latino. These racial demographics are similar in the existing versions of each of those districts.Image of a hypothetical Maryland congressional map that is gerrymandered to elect an eight-to-zero Democratic majority in 2026 and flip the Republican-held 1st District. All districts are colored varying shades of blue depending on Kamala Harris' victory margin for president in 2024, and an accompanying chart displays those results and the racial demographics. Three of the most heavily Democratic seats have majority-Black populations, an increase from two districts on the current map.Image of a hypothetical Oregon congressional map gerrymandered to elect six Democrats and eliminate the one remaining Republican seat in 2026, with every district shaded solidly blue. An embedded chart shows that Kamala Harris would have won every district by at least 10 percentage points. Harris won by at least 12 points in every Democratic-held district and by 10 points in the Republican-held 2nd District, which includes most of eastern and central Oregon along with part of eastern Portland.Image of a hypothetical Virginia congressional map that is gerrymandered to elect a ten-to-one Democratic majority and flip four Republican seats in 2026. Nine of the districts are securely Democratic and shaded solid blue, one of the districts is overwhelmingly Republican and shaded dark red, and one district is narrowly Democratic-leaning and shaded light blue.

An embedded chart shows the results of the 2024 presidential election in each district, with Kamala Harris winning nine districts by double-digit margins and the swing district by 3 percentage points. Republicans votes are wasted by being packed into a single district in western Virginia that Donald Trump won in a 55-point landslide. Black voters would retain their current ability to elect their chosen candidates in the safely Democratic 3rd and 4th districts in the Hampton Roads, Richmond, and Southside regions.
