AWFUL news tonight. This blesses the “mandatory” detention in the 5th Circuit without bond (and little chance at habeas) of every undocumented immigrant who originally entered across the border, no matter how many decades in the past. It will fuel ICE’s push to transfer people to Texas immediately.

Federal judge: "The presumption of regularity that has previously extended to [the United States Government] that it could be taken at its word—with little doubt about its intentions and stated purposes—no longer holds." This is in a case where the Trump admin sued Oregon.
While the Court’s decision granting Defendants’ and Intervenors’ motions to dismiss are firmly grounded on the application of law, Plaintiff’s conduct and written demands on states for disclosure of their highly sensitive voter information should not be ignored. Defendants’ and Intervenors’ expressed concerns about Plaintiff’s ulterior motives for seeking the sensitive data require attention. The presumption of regularity that has been previously extended to Plaintiff that it could be taken at its word—with little doubt about its intentions and stated purposes—no longer holds. When Plaintiff, in this case, conveys assurances that any private and sensitive data will remain private and used only for a declared and limited purpose, it must be thoroughly scrutinized and squared with its open and public statements to the contrary.

#BREAKING A federal judge in Indiana has found that immigration authorities are unlawfully detaining the Chicago man acquitted of the alleged Greg Bovino murder plot. He must either be released or be given a bond hearing by Wednesday.
ORDER GRANTING PETITION FOR WRIT OF HABEAS CORPUS
Juan Espinoza Martinez is a noncitizen who was arrested by U.S.
Immigration and Customs Enforcement ("ICE") agents on January 22, 2026. He
is detained at the Clay County Jail in Brazil, Indiana, while his removal
proceeding—sometimes also referred to as a deportation proceeding—is pending.
On February 2, 2026, Mr. Espinoza Martinez filed a petition for a writ of habeas
corpus under 28 U.S.C. § 2241, seeking release from custody or alternatively a
hearing where an Immigration Judge could consider the specific facts and
circumstances of his situation, determine whether he presents a flight risk or
danger to the community, and decide whether he will be released on bond or
held in detention until the removal proceeding is completed. For the reasons
explained below, the Court finds that Mr. Espinoza Martinez's current detention
is unlawful, and he is entitled to an individualized bond hearing. The Court
therefore grants the petition to the extent that no later than 5:00 p.m. on February 11, 2026, Respondents must either: (1) give Mr. Espinoza Martinez an
individualized bond hearing before an Immigration Judge pursuant to 8 U.S.C.
§ 1226(a); or (2) release him from custody, under reasonable conditions of
supervision.
