New Misdemeanor Deferred Prosecution Program broadens access to Restorative Justice Community Courts and community-based services

CHICAGO – For the first time, the Cook County State’s Attorney’s Office (CCSAO) will refer low-level, nonviolent misdemeanor cases to Restorative Justice Community Courts (RJCCs) and other deferred prosecution programs. The expansion will connect eligible individuals who don’t pose a public safety risk with community resources and support as they work toward resolving their case. The initiative aims to address underlying factors that contribute to criminal behavior while promoting accountability and reducing the prevalence of repeat offenders.

“By addressing challenges such a substance abuse or mental health, we can make it less likely that these individuals will commit more crimes,” said SA Burke. “When appropriate, we can hold people accountable while also giving them a real opportunity to avoid future involvement in the criminal justice system.”

The CCSAO’s Misdemeanor Deferred Prosecution Program (MDPP) takes effect today. The program, developed by the CCSAO’s policy team, in consultation with the Office’s alternative prosecutions and misdemeanor teams, is designed to reduce recidivism, break cycles of criminal activity and increase referrals to places that are within the community.

Qualifying defendants who successfully complete the MDPP program can have their case dismissed and avoid a misdemeanor conviction. The CCSAO will only refer defendants to the program with explicit consent from the victim in the case.

Eligible misdemeanor offenses for MDPP include criminal trespass, theft, reckless conduct, possession of cannabis, possession of drug paraphernalia, and resisting/obstructing law enforcement. Possession of ammunition and possession of a firearm/expired FOID may be referred to the RJCCs, contingent upon a defendant meeting the age, geographic and program eligibility requirements.

If the defendant and their defense counsel accept placement in MDPP, the case will be directed to one of three existing diversion court tracks based on the defendant's background and service needs. These are:

• Veterans Track for individuals eligible for services through Jesse Brown VA

• Behavioral Health/Substance Use Disorder/Housing Track for individuals who may benefit from community-based treatment or stabilization services

• Restorative Justice Community Court (RJCC) Track for individuals aged 18-26 who reside in one of the RJCC areas: North Lawndale, Englewood, Avondale, or Sauk Village

All participants in MDPP, regardless of track, are required to complete an assessment and comply with all recommended services and program conditions. This may include participation in substance use treatment, mental health services, housing support, or other community-based programming, depending on individual needs.

Beyond misdemeanors, the CCSAO has a long history of providing alternative prosecution pathways to individuals in certain felony cases. The inclusion of misdemeanors into diversion programs and the RJCCs marks the CCSAO’s commitment to reducing reliance on traditional prosecution for low-level nonviolent offenses when appropriate.

Providing chairs when job duties don’t really require standing is a textbook example of a reasonable accommodation. Taking away chairs, thereby forcing disabled workers to put in formal requests to aggressively hostile employer, can be a pretty effective way of pushing people out of their jobs.

As is nearly always the case with the president’s accusations, this was an illuminating projection. Trump fears that public pressure on the Supreme Court can sway the justices and how they rule. So when they don’t side with him, he assumes that’s what happened, and he trashes the Court in the hope that it will side with him the next time. He views criticism of the Supreme Court much as he views laws in general: When Trump or one of his allies wants to do something, such as use taxpayer dollars for cultish campaign ads, it’s legal. When his opponents want to do something, it’s illegal

But there’s also something about truth to pain. We talk a lot about truth to power, but I think it’s actually a lot harder to speak truth to pain. I say that as someone who went to medical school, realizing that in a lot of our politics right now, we’ve got to get a lot better at speaking truth to pain if we’re going to get through some of these challenges that we have.

What does “truth to pain” mean?

It’s one thing to look power in the eye and say: You’re wrong about this. But there’s a way in which pain is very difficult to reason with. Because when somebody is in their pain, they’re in their trauma. They see that pain, and they may not see what’s causing it.

I remember just very explicitly being in a trauma ward with a gunshot wound patient and watching this big guy with his hand on his gunshot wound. All the folks are trying to pull his hand off his pain, that point of his gunshot wound, this clear vulnerability.

And this emergency room doctor had the presence of mind to be like: Everyone, stop. And she looks him in the eyes, and she’s like: I get that really hurts, and I’m so sorry that you’re here. You don’t want to be here. We don’t want you to be here. But if you don’t let us fix this, you could die. So I’m going to take your hand, and I’m going to move it off, OK? Because I need to get there so that you can live.

She was speaking truth to pain. He understands he’s at the hospital, he needs care, but he also doesn’t want anybody to touch the wound. Which is a natural thing. And I think it is a really great metaphor for how we think about a lot of these challenges we talked about today.

One of the things to come from GamerGate was the gamification of torturing real, live women...hounding them out of their homes, making them look over their shoulders for years.
