In a groundbreaking opinion that signals a paradigm shift in how courts treat excessive punishment claims, the Pennsylvania Supreme Court today held that mandatory life without parole sentences for “felony murder” violate the state constitution.

Over 1,000 people in Pennsylvania are serving life terms with no chance of release for homicide convictions based solely on their role in some other crime — without any finding that they ever killed or intended to kill anyone. Convicted under the arcane “felony murder” rule, they may have been getaway drivers or lookouts for some other crime that went bad and led to death, and then punished like killers. Under Commonwealth v. Lee, they can now demand a new sentence based on their individual culpability and seek a meaningful chance for release.

Minneapolis Police Chief Brian O'Hara: "People have had enough. This is the third shooting in less than 3 weeks. The MPD went the entire year last year recovering about 900 guns from the street, arresting hundreds of violent offenders, and we didn't shoot anyone ... this is not sustainable."

Dick Fallon was a brilliant scholar, inspirational teacher, and all-around wonderful human being. I owe my career to him. He was the best mentor, and I will miss him. I'm glad I had a chance to tell him how much he meant to me before he passed, but the pain is still searing. RIP to a beautiful soul.

Private incarceration companies are playing a huge role in Trump’s deportation plans. The biggest detention centers in the country are run by private companies – many of which have tried to curry favor with the Trump Administration by donating to Republican campaigns or Trump’s inaugural committee. NYU Law Professor Rachel Barkow says the dynamics mimic the larger prison industrial complex. Co-Creator, Migration and Technology Monitor Petra Molnar says some tracking apps developed by these companies can be efficient, “But right now, what technology is doing is actually replicating racism, discrimination, carceral logic.”
