NEW: DOJ asks Judge Breyer to close next week's trial on the Trump admin's possible violations of the Posse Comitatus Act to remote public access, arguing that it endangers DoD/DHS/ICE officials to let the public see who they are. storage.courtlistener.com/recap/gov.us...
Pursuant to Northern District of California Local Civil Rules 7-11 and 77-3, Defendants
respectfully object to permitting remote public access during the trial proceedings. Local Rule 77-
3(b)(1) permits a court to prohibit remote public access "where doing so would risk interfering with the integrity of the proceedings." "This includes, but is not limited to, situations where remote public access would risk infringing on privacy interests, creating safety concerns, or materially affecting witness testimony." Id.
Those conditions are present here. Yesterday, the parties exchanged final witness lists.
The parties expect the Court will hear testimony from the three individuals who have given deposition testimony, which includes two Department of Defense officials and one official from the Department of Homeland Security Immigration and Customs Enforcement's Enforcement and Removal Operations. It is undisputed that agitators have used social media and the Internet to
coordinate attacks against DHS ICE ERO personnel. See, e.g., DHS Announces ICE Law Enforcement are Now Facing an 830 Percent Increase in Assaults, DEPARTMENT OF HOMELAND SECURITY, https://www.dhs.gov/news/2025/07/15/dhs-announces-ice-law-enforcement-are-now-

individual online with malicious intent—has been another significant safety concern. See, e.g., ECF No. 22-1 (June 11 Santacruz Declaration) at I 33 (discussing the "significant instances of
demonstrators posting the location, images, and family information of federal law enforcement employees online in an attempt to dox, threaten and obstruct"). Providing remote public access to the trial creates safety concerns for the witnesses and attorneys appearing at trial. At a minimum,

WOW. Internal emails obtained by @haleaziz.bsky.social reveal how the State Department scrambled to figure out a PR strategy after they realized the implications of having gotten a triple murderer released from prison decades early. He is current living free in the U.S. thanks to the Trump admin.
In an internal email exchange that was obtained by The New York Times, State Department officials debated whether to include Mr. Hanid Ortiz in a public statement to be published that afternoon about the people being released, 10 including him.
“We had understood that we don’t want to refer to him as a hostage or wrongfully detained, which is why we said nine,” a press official wrote.
Michael Kozak, the career official who oversees diplomacy in the Western Hemisphere, replied: “Well then we probably should not have asked for him. Can we now extradite him to Spain? We did get the S.O.B. released.”
Finally, Mr. Kozak made the decision to include him: “Well I would stick with 10 as we did ask for and receive 10.” He added that the fact that at least one “is a bum does not change that fact.”
That afternoon, Secretary of State Marco Rubio released a statement saying that Mr. Trump’s leadership had led to the release of the “10 Americans.”
“Every wrongfully detained American in Venezuela is now free and back in our homeland,” Mr. Rubio said in the statement.

how it's going in texas
At the start of a contentious, hours-long hearing in the Texas House of Representatives to debate the new, GOP-drawn congressional map, Rep. Jon Rosenthal (D) had a pointed question for Rep. Cody Vasut (R), the chair of the House redistricting committee.

“My question is, does the leadership of the state truly think that the constituents, the people of Texas, are that stupid?” Rosenthal asked Vasut.

Vasut never answered the question.
