Page from 8/14/26 Double Jeopardy Motion via Luigi Mangione's Legal Defense:
"38. However, federal jurisprudence has reduced centuries of double jeopardy traditions to rubble through the following sleight of hand: "an offense is defined by a law, & each law is defined by a sovereign. So, where there are 2 sovereigns, there are 2 laws, & 2 offenses." Id. This syllogism allows someone to be prosecuted 51 times for the same offense without violating the Fifth Amendment Double Jeopardy clause because each state & the federal government has its own body of laws. Here, however, the constitutional violation committed by virtue of the 2 governments acting in concert to deprive Mr. Mangione of a legislatively created affirmative defense is not dependent on the Fifth Amendment's Double Jeopardy clause but rather the Due Process clause. Accordingly, [post's screenshot highlights this line:] rather than exhuming the once vital doctrine of constitutional double jeopardy, we leave it dead in the earth, where the Supreme Court buried it decades ago, & turn instead to due process to avenge this wrong.
39. The damage & prejudice suffered by Mr. Mangione in connection with the dual New York/federal prosecutions here is not their serial nature but rather that the 2 sovereigns acted in concert with each other, & that they specifically did so to best ensure that each got their chance to prosecute & convict Mr. Mangione, & that the Criminal Procedure Law of this State would not interfere with this coordinated effort. Moreover, the damage & prejudice here is due to the concerted efforts of the District Attorney's Office to try the state case, which has an affirmative factual defense, before the federal case, which does not.
40. This presented Mr. Mangione with an intractable constitutional dilemma where he would have to choose between which case to defend. By defending the state case & availing himself of the affirmative defense New York law provided him, he would necessarily implicate"

fuck ai 🥰
screenshot of last three paragraphs of moser's AI hater piece (link in moser's post): "I do understand: you want permission. There’s a machine in the corner wrapped in human skin that makes things out of shit and blood to look like whatever you want (as long as you don’t look too closely). You gave one to your teacher and they didn’t notice. Your boss told you to use it after they laid off half the team and it was fine. You fed one to your kids and they liked it. You want to know you can use it sometimes without me thinking less of you. You don’t need me to believe it’s useful, you just want me to be polite about it.

But I am a hater, and I will not be polite. The machine is disgusting and we should break it. The people who build it are vapid shit-eating cannibals glorifying ignorance. I strongly feel that this is an insult to life itself.

I became a hater by doing precisely those things AI cannot do: reading and understanding human language; thinking and reasoning about ideas; considering the meaning of my words and their context; loving people, making art, living in my body with its flaws and feelings and life. AI cannot be a hater, because AI does not feel, or know, or care. Only humans can be haters. I celebrate my humanity." end of screenshot text; i highlighted the last two sentences.

May her memory be for a revolution. May it deepen our commitments. May her example sharpen our politics. May her life remind us that disability justice is a practice of transforming the world through collective care, accountability, creativity, defiance and imagination.

Alice Wong’s legacy is the political horizon she helped articulate. A horizon where disabled knowledge is central, and care is a shared commitment. She taught us to name grief & rage without collapsing under them, to celebrate disabled brilliance without ignoring the material conditions shaping life

NEW: A SECOND story was released today of a Venezuelan man disappeared by the Trump admin. Neiyerver Leon is a barber who entered legally seeking asylum in June 2023. ICE arrested him on March 13 and accused him of being in TdA. Days later, he vanished off the face of the earth.
Leon Rengel was briefly held at East Hidalgo Detention Center, a private facility in La Villa, Texas, used by Immigration and Customs Enforcement.

Then — nothing. His alien number, a way to track his whereabouts, vanished two days later from ICE’s online system. He disappeared. ICE agents told Gutierrez her boyfriend had been deported to his home country. But the family has searched in Venezuela, and he isn’t there, she said. “I’ve been to the ICE office. I’ve contacted the FBI. The DEA. Everyone told me the same thing: He was deported,” Gutierrez said. “But where to? He never arrived in Venezuela.” It’s possible that the Trump administration deported Leon Rengel to a mega-prison in El Salvador, where hundreds of other Venezuelans were sent last month — but there is no official record to confirm it.

NYU Faculty Take Classes Off Campus to Protest Lack of Protections for International
Students
NEW YORK, April 17, 2025 - More than fifty NYU faculty members have taken their classes off campus starting today, and continuing for the next week, to protest the University's lack of commitment to protect international students in the face of the Trump administration's attacks. Some faculty have moved their classes to in-person locations that have been declared sanctuary spaces, where international students are assured that building administrators will do everything in their power to refuse to cooperate with ICE agents. Other faculty have moved their classes online so that students can attend from a safe location of their choosing.

Something the "so you think the law means anything now" doomers fail to grasp: the importance of buying time. Nobody, and I mean NOBODY, has infinite resources and infinite capacity for managing complexity. Make your opponent work. Make their every decision complex and their every move costly.

The absolute glee some are displaying in blaming Palestinians, and people who protested on their behalf, for their own ethnic cleansing is a strategic error (obvs you target the decision maker), a political error (obvs you need those votes), and a moral error (obvs fix your hearts or die).

anyone know people with, &/or have an email for, @pronyc.bsky.social? it's a super well-known resource that's fallen behind the last ~6 months; i'd like to send updates & corrections, but their site only provides social media links, & they've been "on hiatus" since early january...
screenshot of an email i started, subject line, "Corrections, updates, etc."; in the "to" field i've written "WAIT THERE'S NO EMAIL," cuz i realized i don't know where to send this!

body of email shows a list of corrections to the pro nyc calendar; i've used a red "X" if the event is not happening, a clock emoji if they need to update the date &/or time, & a link emoji if i've given a new link. the text is very unexciting administrative stuff, cut off at the bottom & top, & what's visible concerns listings for monday through wednesday:

🔗 / ⏰ Ceasefire Now – Vigil –– This event now happens 5pm-6:30pm; I'd update to this post: https://www.instagram.com/p/C4n1tKFu65u/ or, perhaps safer, just link to the account: https://www.instagram.com/uptown4palestine/.

FEB 4 (TUES)

❌ NoMore24 Flyering –– not happening (see Weds note)
⏰ / 🔗 Solidarity Rally [NJ] –– This now takes place weekly on Wednesdays, as per https://www.instagram.com/p/DFGutE_S-1X/.
❌ Weekly Vigil for the Martyrs –– I don't believe this is happening weekly Tuesdays; I dm'd the 3 accounts on post, waiting to hear back.

FEB 5 (WEDS)

🔗 NoMore24 Flyering → Now weekly picket, happening Wednesdays, 10am-11:30am, as per https://www.instagram.com/p/DFGvSyqOG5u/.
❌ Genocide Protest at U.N. –– These happen occasionally, but it's not a regular / monthly event; their last two protests were in November & August.
❌ Teaneck Peace and Justice Vigil (NJ) –– No indication this is still happening; dm'd, waiting to hear back.
❌ Black Trans Liberation Kitchen –– Not happening this week (as per https://www.instagram.com/p/DEQwxVHvqog/), back 2/12.
