Accordingly, [post's screenshot highlights this line:] rather than exhuming the once vital doctrine of constitutional double jeopardy, we leave it dead in the earth, where the Supreme Court buried it decades ago, & turn instead to due process to avenge this wrong.

The damage & prejudice suffered by Mr. Mangione in connection with the dual New York/federal prosecutions here is not their serial nature but rather that the 2 sovereigns acted in concert with each other, & that they specifically did so to best ensure that each got their chance to prosecute & convict Mr. Mangione, & that the Criminal Procedure Law of this State would not interfere with this coordinated effort. Moreover, the damage & prejudice here is due to the concerted efforts of the District Attorney's Office to try the state case, which has an affirmative factual defense, before the federal case, which does not.
40. This presented Mr. Mangione with an intractable constitutional dilemma where he would have to choose between which case to defend.
