Schmitt’s attempted maneuver this morning deserves ridicule, but there’s a more serious aspect to it. He was trying to frame Jack Smith. This was no innocent mistake, but part of a calculated effort to bear false witness against a person in order to harm the credibility of his work and character.

It's been somewhat lost in all of the other bad things Hegseth has done (ranging on a spectrum from "comedically ridiculous" to "almost certainly a provable war crime"), but one of the most toxic legacies of his tenure will be the growing idea that civilian influence in the military is bad.

Proof beyond a reasonable doubt that Trump and Co. conducted a criminal conspiracy to defraud the United States out of its presidential election — ie attempted an autogolpe, or "self-coup" — was in the public record. The facts and the law were never in question. Only if America would follow them.

Talking recently to family members of people snatched up and expelled to third countries by ICE, I learned: 1) All of those captured were in 287(g) jurisdictions; 2) None of the family members had known what 287(g) was and had erroneously thought people with no arrests were safe.

ICE is now lying in wait outside convenience stores, or at busy intersections. Agents are arresting people at international airports. Local police and sheriffs, deputized by the federal government, are detaining immigrants during traffic stops. ICE is now detaining more immigrants than ever before.

Gone are the mass raids and militarized metro operations. Gone are the pomp and pageantry. But ICE arrests have hit record levels. ICE operations are no longer concentrated in large American cities. Immigration enforcement officials are also working in suburban and rural areas, all across the US.

An ICE official desposed for this case was so evasive during a deposition that the judge declared her not credible. At one point, when asked to give a rough estimate of how many people were being held at 26 Federal Plaza in NYC in June 2025, she responded with "there's no such thing as an average."
Despite these facts, ICE officials – particularly Zanello – at other points in this case have attempted to downplay the level of overcrowding that existed during the summer of 2025. As the day-to-day supervisor of the tenth-floor hold rooms who was present on the tenth floor on at least most days from 7:00 a.m. to 3:00 p.m., she was quite evasive about how many people generally were held there at a time. [see Footnote 114 in next image] 

She would not provide even an estimate. In addition to her unbelievable claims that she could not recall approximately how many people were being held at any given time and that there is no such thing as an average number of people who were being heldFootnote 114: (“Q. Over the summer of 2025 while you were there . . . there were often 100 people held on the [tenth-]floor hold rooms at a time. Right? A. I would have to look at the day. Q. What is your best recollection as you sit here of the average number of people who [were] being held in the [tenth-]floor hold rooms in July 2025? A. There is no average that you can provide . . . . [T]he best I could do was a high and a low. Q. Okay. What’s the high and the low? A. I don’t know. Q. . . . [L]et’s take one time period each day. Let’s take noon . . . . I’m asking you how many people do you recollect being held? A. It depends on the day. I would have to look at the day. Q. But you have no recollection of what the numbers were like as you sit here today under oath? A. It could have been zero. It could have been max. I don’t know. I would have to look at the day. Q. Okay. Give me a rough estimate of one of the most crowded days you can remember? A. I would have to look at the day. I’m not going to guess on a number. Q. Fair to say that at times there were more than a hundred people at a time? A. I would have to look at the day . . . . Q. Myself and other immigration attorneys have noticed that the government has paused most citizenship applications that have already been approved and are only waiting for a swearing-in-ceremony. Our guess is that they're intentionally delaying these until after the mid-term election.

Incredible. First Secretary Mullin claimed that DHS had identified 15,903 noncitizens on Nevada’s voter roll. Then DHS officials told a skeptical Nevada, no no no, that’s just people we flagged. Here are the names of 185 people we KNOW aren’t citizens. All 185 were citizens. DHS got 100% wrong.
When the Department of Homeland Security sent Nevada a list of 185 names last month that it claimed identified noncitizens who had been improperly allowed to register to vote, state election officials got to work.
On Tuesday, the state sent a strongly worded rebuke to the federal government: Every single person on the list was a lawful citizen.
"As for the 185 individuals, our records indicate that they were citizens," Greg D. Ott, a deputy attorney general in Nevada, wrote, according to a copy of a letter sent to Department of Homeland Security officials obtained through open records requests.
"You have provided nothing of substance to suggest otherwise."Following the meeting, Ms. Vogt sent a clarifying email to Nevada officials. "I also wanted to be sure I clarified that we did not reduce the 15,903 to 185," she wrote. "We've manually reviewed some of the 15,903 and confirmed 185 are not U.S. Citizens."
Now, Nevada officials are saying even that 185 number is wrong. They also took issue with a letter D.H.S. sent them in early September, in which the agency reiterated its initial claims about nearly 16,000 noncitizens on the rolls and pressured state officials to review each case in a letter to Nevada officials in early September.
