Justice Alito devotes an entire chapter of his new book to the emergency docket—and to responding to people like me (“the most prolific academic critic of the emergency docket”). As I explain over at “One First,” it … didn’t go well: www.stevevladeck.com/p/256-so-une...
In the pre-publication galleys to his new book, So Ordered: An Originalist’s View of the Constitution, the Court, and Our Country, Justice Alito spelled my last name inconsistently. This is, I suspect, the pettiest possible point on which to open in discussing a Supreme Court justice’s new memoir, and I would never have mentioned it except for the fact that inconsistency turns out to be the organizing feature of the chapter in which I (“the most prolific academic critic of the emergency docket”) repeatedly appear. The central inconsistency of Chapter 8, which is devoted to the emergency docket, is structural: Rather than tackle the subject holistically (as one might expect in a book), Alito mashed together the speech he gave five years ago at Notre Dame Law School with a “postscript.” The former was deeply flawed even at the time (among lots of other things, Alito repeatedly insisted that there was “nothing new” about the Court’s behavior on emergency applications during the first Trump administration and COVID); and the latter tries to move the goalposts away from the specific phenomena to which critics like me have actually objected. The result is to leave readers with a disjointed, inaccurate, and misleading sense of what the debate is even about—to say nothing of how the Court’s own behavior since September 2021 (including Alito’s) has only further undermined the already-flawed claims Alito made back then. Somewhere between the galleys of Alito’s book and the final product (which hits bookstores today), someone apparently figured out that my last name should be spelled the same way (and correctly!) throughout. The other, more significant inconsistencies were, apparently, harder to fix.

Andrew Granato: Zhang and Zimmerman argue that The GENIUS Act permits firms to subject a firm's existing creditors (including the FDIC and taxpayers if the firm is a bank) to a functional dropdown by just issuing a stablecoin immediately prior to filing for bankruptcy:

Abstract
The GENIUS Act of 2025 rewrites the priority and estate-property rules that govern the failure of a payment stablecoin issuer. It removes an issuer's required reserves from the bankruptcy estate and grants stablecoin holders a superpriority, capped at any reserve shortfall, over what remains. The commentary so far asks what happens inside bankruptcy once an issuer files--whether holders are actually paid and whether the case can be administered. This article identifies a different problem that arises before a filing. Because reserve assets leave the estate the moment they back a coin, a distressed firm can issue stablecoins to subordinate its existing creditors, hollow out the value a future administrator would need, and, when the firm is a bank, shift losses onto the deposit insurer and potentially the taxpayer. We call this stablecoin-on-creditor violence, drawing an analogy with the phenomenon of creditor-on-creditor violence that began with the 2016 J. Crew dropdown. Unlike in that episode, the stablecoin dropdown is on a statutory footing, meaning it is largely beyond the reach of the doctrines courts use to police its private-law cousins. We show that the subordination is accomplished by the rule carrying reserves out of the estate rather than by the celebrated superpriority. We raise concerns for financial stability: the threat of a dropdown grows with a firm's holdings of safe assets, meaning that creditors may respond negatively to a firm with a more liquid balance sheet. The harm is gravest when the subordinated creditor is the FDIC or another deposit insurer, because losses can be imposed on the rest of the financial system and the taxpayer. Importantly, the problems we raise…

A black-and-white portrait of Lottie Dod (Charlotte Dod, 1871–1960), the legendary English athlete who remains the youngest singles champion in Wimbledon history, winning her first title in 1887 at age 15. Captured from the waist up, Dod stands at a slight three-quarter angle facing right while looking directly forward. Her expression is calm, earnest, and determined, featuring a soft mouth and steady, dark eyes. Her dark hair is pinned up neatly under a rigid, light-colored cloth cap with a short brim, sitting straight on her head. She is dressed in traditional Victorian tennis attire, wearing a structured, high-collared white blouse with voluminous leg-of-mutton sleeves and pleated detailing across the chest. Her waist is tightly cinched by a broad, dark belt that fastens over her dark skirt. In the lower right foreground, she cradles a vintage wooden tennis racket with a distinct asymmetric, flat-topped frame and tight natural gut strings, which extends diagonally across her body. The background is a soft, mottled gray studio backdrop, drawing all focus to her silhouette. The lighting is soft and even, highlighting the texture of her clothing and her complexion. The composition captures the classic, grainy texture of late-19th-century photography, creating a dignified, historic mood that underscores her pioneering status as an early sports icon.

Here in North Austin, where ICE agents appear to have shot an individual in his car. I spoke to two of the only witnesses.

Nedevia Bolaños and her husband, Carlos, own a business just off the intersection where the shooting happened. Shortly before 1 pm they says they heard what sounded like two gunshots. Carlos ran out first. A blue Toyota sedan and a black Escalade were stopped under the highway.Combined tweets, cutting tags and other such

He said he saw an olive-skinned man, seemingly in his 30s, leaning backwards against his seat. A masked agent was standing outside the car. The agent refused to answer questions. Within a few minutes as many as 10 other ICE agents arrived.

Carlos asked the victim if he was ok. "Yes," the man said in Spanish, but he looked exhausted. Carlos asked why they had shot him. "Because I didn't stop."Combined tweets, cutting tags and other such.

Bolaños ran up next. She said she continously asked the ICE agents about why they'd shot him and if they were going to render aid. They didn't answer her. It was an APD officer who later arrived and cut open the young mans shirt, revealing a deep hole between his shoulder blades. The ambulance arrived about 10 minutes after and carried him off. "I've never seen all this. Thank God I'm a citizen," Bolaños said in Spanish. "Or I'd be living like this. In a dream of terror."

you can just do things
In February, a company processing debit-card transactions for Polymarket's U.S. betting platform delivered some alarming news:
Fraudsters were flooding the app.
Users were linking stolen debit cards to Polymarket US accounts, then trying to use them to make wagers and withdraw the money into clean cards or accounts they controlled. Thieves tried to make off with at least $10 million.
At one point, the processor rejected as fraudulent more than 80% of the deposits it was handling, a rate that far exceeded industry standards of roughly 1%. Polymarket employees quickly raised their concerns with Chief Executive Shayne Coplan, according to people familiar with the events.
The compliance team, those people recalled, was floored by Coplan's response: Just keep growing and pay a fine if regulators ever find out.
Current and former employees said Coplan's reaction, which hasn't previously been reported, was characteristic of his plan for Polymarket-growth at all costs.
