So: Calm down about the First Amendment already. We do not need the Supreme Court to overrule its existing precedent. We do not need a new federal law. If you’re mad about the 7th Circuit ruling and you think people who engage with AI-CSAM belong in prison, this paper has some great news for you.

This amount of parental supervision for teens' communications is ghastly. Drafters likely imagined kind parents helping an out-of-control kid. But the reality is that many, many kids have abusive parents. Imagine trying to reach out for help, but being trapped in the situation this describes.
Meta agrees to provide Supervising Parents with information concerning the
amount of time their Teen User is spending on Meta SMPs, including separately
for time on the Meta SMP, time using the Meta SMP’s messaging features, time
viewing Longform Content (to the extent excluded from the calculation of daily
limits pursuant to Section II.B.3.a.i), and the usernames of the Teen User’s social
connections and individuals messaging the Teen User, and usernames of any user
reported by a Teen User. In addition, Instagram will notify Supervising Parents
should their Teen User engage in repeated searches for terms related to suicide,
self-harm, or eating disorders, and Facebook will notify Supervising Parents
should their Teen User engage in repeated searches for terms related to suicide,
self-harm, or eating disorders.
2. For Teen Users, Supervising Parents will be notified on a daily basis when the
Teen User communicates directly with each adult user for the first time with the
Teen User and shall provide a link to the adult user’s profile to provide information
such as their stated hometown or city or mutual connections, to the extent the
information is publicly available.If a Teen User is enrolled in Parental Supervision, Meta shall notify the
Supervising Parent if the Teen User creates or explicitly links a new secondary
Meta SMP account within their Accounts Center or has been linked to a Soft
Matched Account through Meta SMPs, including a link to the secondary account’s
profile. Meta SMPs shall automatically apply the Supervising Parent’s approved
time management settings in Section II.B and content restrictions to all explicitly
linked Meta SMP accounts and all Supervised Accounts for a Teen User belonging
to the same Meta SMP.

TLDR: If it were real CSAM possession would be criminal because of the harm to real children, but it's not evident that there was any such harm here, and because it's obscene rather than CSAM private possession is legal because you're not protecting the community.

Judges Lee and Kolar went out of their way to write a concurring opinion asking for the Supreme Court to look at this issue again in light of new tech. They want this to be illegal, they just don't think it is under current law, so knock it off with the "check Judge Lee's hard drive" cracks.

There are people better qualified to comment on this (I know @hipcrimevocab.net specifically has handled 1466A cases before), but a lot of people have very bad takes on this so I'm going to try to clarify. A 🧵 This ruling is only on *possession*. Creation, distribution, etc are still illegal.

Both bills claim to protect children, and neither do so, but both cause harm:

-S.1829 would destroy encryption, which given data breaches like Discords recent leaks, imagine similar breaches but with credit card and other vital info.
-S.1748 would cause drastic over-moderation, and removal of user-content regardless of legality (dire free speech issue).

CSAM is already legally required to be reported when suspected.

I'm messaging to demand [SENATOR] oppose S. 1748, the Kids Online Safety Act, also known as KOSA. This broad legislation does not protect anyone and instead will be used to block any speech that the Trump administration’s partisan FTC disagrees with. It pushes the “duty of care” onto websites and social media platforms to remove content that is “harmful to children”. It would lead to overcompliance, mass censorship, and remove access to crucial information re: everything from mental health, LGBT topics, substance abuse, eating disorders and more. 
Additionally, while large, corporate platforms like X can shoulder the weight of “duty of care”, smaller websites cannot, leading to greater and greater concentrations of power online into giant corporate platforms rather than small and medium sized businesses. 
KOSA will not make kids safer. It will make the internet more dangerous for anyone who relies on it to learn, connect, or speak freely. Lawmakers should reject it, and fast.
