In @slate.com, Reva Siegel examines how SCOTUS's birthright citizenship opinion shows how people outside the courts have long shaped the Constitution. She spotlights a key development: for the first time, the Court recognized Frederick Douglass as a framer. Historians helped the Court get there 🧵⬇️

Freedom Was in Sight!
This book by Professor Kate Masur and artist Liz Clarke is a graphic history of Reconstruction in Washington, DC. Professor Masur writes, "When we place the enormous significance of slavery's destruction at the center of Reconstruction history, it makes sense to alter our understanding of when the period began and ended. Instead of starting in the spring of 1865, when Confederate generals surrendered to their U.S. Army counterparts, we begin with the onset of the Civil War in 1861, when soldiers of the U.S. Army entered the slave states and enslaved people began escaping toward U.S.

SCOTUS opinions can be baffling and inaccessible, but if there is something, anything people should read about birthright citizenship, it is the amicus brief of Martha S. Jones & Kate Masur. If it doesn't make you believe in the power of change & the good possible in the Constitution, nothing will.

really cannot be emphasized enough that the drafters of the birthright clause very much considered cases analogous to undocumented immigrants and *included them too*

To exclude children born here from citizenship because their parents are temporary or undocumented immigrants is to betray both the letter and the spirit of the 14th Amendment. From the start, birthright citizenship was understood as a vehicle by which “all persons” born here would become full members of a newly remade democracy.
