5th Cir. issues a rare Saturday order. Holds that the Supreme Court's stay in D.V.D. forecloses a stay of removal for a Senegalese man with witholding of removal to Senegal who DHS intends to immediately deport to Sierra Leone. www.ca5.uscourts.gov/opinions/pub...
Separately, the Supreme Court has effectively ratified third-country removal of the sort that Gakou faces when it granted certiorari in a case raising the issue while still explicitly permitting the government to continue with third-country removals unabated pending full resolution on the merits.  See DHS v. D.V.D., Nos. 26-426, 26A406 (U.S. Sept. 29, 2026) (per curiam).  As a result, Gakou’s claim to an injunction against his removal to a country besides Senegal is unavailing and cannot be used to support the stay he currently seeks. Because Gakou has not demonstrated any meaningful probability of success on the merits, he is not entitled to a stay.  The emergency motion for a stay pending appeal is DENIED.

ICE moved my client in this case to Camp East Montana in El Paso yesterday afternoon, with no notice to me or his immigration attorney. On the Friday afternoon of a long weekend. He was off the detainee locator system until this morning. We had no idea whether he'd been illegal deported or not.

All told, the Supreme Court’s decision to stay the district court’s vacatur order in D.V.D. must “inform how [we] should exercise [our] equitable discretion in like cases.”  Boyle, 145 S. Ct. at 2654.  And this is not just a like case; in some respects, it is the same one.  We understand Ojukwu’s frustration with these events.  A district court involuntarily forced her into a class action in a faraway venue and thereby undermined her ability to pursue her own equitable relief in a court closer to her Ohio home.  The choice to certify the class also “foreclos[ed] adjudication by a number of different courts and judges” (which could have helped the Supreme Court render its ultimate decision) and increased “the pressures on [that] Court’s docket.”  Califano v. Yamasaki, 442 U.S. 682, 702 (1979).  So courts should always exercise caution when certifying a “nationwide” class action.  Id.  Perhaps the Supreme Court will soon clarify whether the district court properly exercised that caution in D.V.D.  In the meantime, though, the Court has made clear that the equities favor the government.  We must reach the same result in this similar case. Therefore, the motion for a stay of removal is DENIED.

Local sovereignty was, of course, the legal argument the Confederacy made to continue white supremacy, and, like most other legal doctrines designed to protect minority populations, it's being flipped so that "nullification" is now something local leaders do to fight fascism.

It’s a crime to knowingly give false info to police. Making a false report. Lying to police. The tin can can‘t knowingly anything, but humans can cause a tool to commit a crime. I do wonder if the responsible people escape liability because they allowed it to act without them knowing. Seems bad.

This whole thread is tough to read but important context. Again, even Haitians who entered under Biden may have no safety in Haiti, may have fled to eg S. America years earlier, their families too. Their kids US born or Chilean or Argentine or Brazilian. Folks who had TPS should all get to stay too.

One of the biggest routine lies by the Trump admin is that if someone in detention gives up, they'll be immediately deported and can leave detention. That is just completely false.

I think that’s reasonable… and what I worried is the opposite, that some ICE goon failing to identify is going to get treated like a carjacker by an armed motorist quite reasonably believing they’re about to be murdered by a carjacker. I don’t think that ends well for anyone.

So, the false info to Philly PD, seems like that’s a crime, the perjury-tool created by people breaks a law, people may have committed crimes. Mens rea question! But what leaped out to me is, if they’d had an immigration lawyer, visa applications wouldn’t have been incomplete.

Admin Law comes flooding back - there’s rules for an adjudication, and due process that goes with it. And there’s other rules for a rule-making, such as a reg, and the due process required isn’t the same. They pretend, not to overturn decades of precedent, but that they can rewrite it, unasked.

This afternoon in Marble Hill, a New Yorker was shot by an ICE agent in a residential neighborhood. Early reports indicate agents surrounded him and a 5-year-old child in his car before firing multiple rounds. We believe the child was physically unharmed.

This is an unconscionable and incredibly serious situation. I have called the President; when we speak I will demand that he ends all ICE enforcement actions in our city. I will not stand by while ICE agents terrorize our communities.

Our thoughts are with the injured New Yorker and his family tonight. We are praying for his recovery.

Get ICE out of our neighborhoods. Get ICE out of our hospitals. Get ICE off our streets. Get ICE away from our children.

Abolish ICE.

Right. Among other things, we haven’t had to as a society figure out our priorities, because of the abuse of labor. This thread is about the labor abuse part. Fix that, and the pain moves to a different point in the chain.
