It's already illegal. Congress banned it near-unanimously in 2022. That law allows the ban to be lifted only if Russia withdraws from Ukraine. He's simply breaking the law that's already on the books.

My husband did his graduate thesis building a LLM for emergency services that he hand-trained on public tweets posted during Hurricane Irma. He found that there was a marked period of "oh no the storm is an imminent threat" followed by a separate distinct "shitposting is my new god now" phase.

The theory that we need to immunise big AI companies from liability, or else China wins, is literally the national socialism of risk - the privatisation of profit. If your company poses existential risk, the company should - at the least - suffer existential liability. In case anyone survives.

For all the rigorous IP law that protects corporations, we sure don’t seem to have any ownership of our own IP and corps seem both willing and able to steal and use it in any way they see fit for essentially the cost of upload & marginal compute. The double standard is real and undisputable.
