The first results are out in today’s regional German election in Saxony-Anhalt, and they show the far-right AfD at 44%, a historic result and surge. It remains unclear whether that’ll be enough for them to have an absolute majority. If not, all other parties will be pressured to block... will they?

In the 1780s and 90s George Washington kept his Philadelphia-based household staff enslaved despite Pennsylvania’s gradual abolition laws by trafficking them out of the state and back into the state to reset the clock every 6 months despite the fact that he had publicly supported the laws.

Justiciability doctrines keeping genuine disputes out of federal court is a major ongoing issue, and not solely a partisan one. Providing a forum for the peaceful resolution of disputes is part of what this whole sovereignty idea is for.

But the context is not neutral. Entertaining the Compact 2.0 legitimizes the Trump Administration’s clear design to impose their ideological preferences on higher education. As academic faculty and staff, it is important to keep in mind that authoritarian entrepreneurs will use the seeming appropriateness of some aspects of McMahon’s letter to draw their campuses into an exercise that subordinates academic independence to Trump’s political authority.
