The people of Sackets Harbor—and especially the school administrators and teachers—should serve as an example for us all that resistance can work. You do not need to comply in advance. The Trump administration is powerful, but not invincible.

This story is a reminder to journalists that reporting on things happening in the smallest places can have the largest impact. My hats off to the local journalists who first made noise about this miscarriage of justice. I feel fortunate that I could help amplify it, and that we can celebrate this small but powerful victory.

And we can rest a little easier knowing the third grader will finally get to see the welcome home banner hung by classmates with love.

Defendants contend that Burkle could have used the shower water to clean the feces and vomit from the cell floor. Further, Defendants argue that Burkle's defecation and vomiting was less severe than that previously held to violate the Eighth Amendment in Taylor v. Riojas, 592 U.S. 7 (2020), because Burkle had not shown a clogged drain.
It is well-established that filthy and unsanitary cell conditions may violate a prisoner's Eighth Amendment rights. See, e.g., id. at 9 n.2 (holding that "massive amounts" of feces in plaintiff's seclusion cell, his being deprived restroom facilities, forced to relieve himself in his cell, and forced to sleep on the cell floor violated the Eighth Amendment); Palmer, 193 F.3d at 352-53 (determining that plaintiff's confinement to a small area without restroom facilities and in unsanitary conditions for seventeen hours deprived him of the basic elements of hygiene); Gates, 376 F.3d at 338-40 (holding that plaintiff's confinement to unsanitary cell conditions implicated the Eighth Amendment's protections); see also Hope v. Oh my god. They deported a man who an immigration judge had declared was "more likely than not" to face persecution in El Salvador ... to El Salvador, during the big March 15 AEA flights! They outright admit it! Yet the Trump admin's response to a court is basically "oops, well, no take backsies."
Plaintiffs allege that, on March 12, 2025, Abrego Garcia was stopped by ICE officers, who informed him that his immigration status had changed. Id. ¶¶ 48–50; see also Cerna Decl., infra Ex. C, ¶ 11. After being detained, he was questioned about gang affiliations and transferred ultimately to a detention center in Texas. Compl. ¶¶ 53, 56; Cerna Decl. ¶¶ 2, 11. Plaintiffs allege Abrego Garcia was told he would be removed to El Salvador and detained at the CECOT prison there. Compl. ¶¶ 56–57 & n.1. On March 15, although ICE was aware of his protection from removal to El Salvador, Abrego Garcia was removed to El Salvador because of an administrative error. Cerna Decl. ¶¶ 12–15. On March 16, a news article contained a photograph of individuals entering intake at CECOT. Id. ¶ 59. Abrego Garcia’s wife identified one of the detainees depicted as her husband based on his tattoos and head scars. Id.

That it was less than 72 hours between his arrest and ICE illegally putting him on a plane to El Salvador (which ICE itself admits should not have happened!) shows how slapdash this operation was. Of course, ICE would never have admitted this kind of colossal screw-up if they hadn't been sued.

Seems like claiming to be an ICE agent would be a great cover story for any and all hooded thugs to kidnap somebody off the street. Seems like it'll be increasingly hard to keep track of who's being kidnapped on the government's orders and who's being disappeared for some other reason.

The biggest reason government officials aren't giving any specifics about the criteria by which these arrests and deportations are selected, is that the criteria is "pro-Israel think-tanks and advocacy organizations created lists of troublesome individuals and gave them to us."
