Agree that I'd prefer candidates/groups here do more of a "How to Vote/Rank" or even a "Rank X last" approach to voter education, vs. "don't rank X." Works fine in Australia, where staff from each candidate/party hand out "how to vote" flyers outside the polling booth on election day.

Insightful legal analysis of a highly problematic component of the Senate permitting deal (Sec. 1402) highly touted by bill proponents as a solution to Trump's War on Renewables but is in fact a major gift to all developers—in particular fossil fuels—that will hobble a future POTUS' climate action.
From attorney Matthew Littleton: "Section 1402 of the draft bipartisan permitting bill is deeply problematic. The apparent goal is to stop Presidents from imposing hard or soft bans (“pauses”) on development of certain types of energy resources. Whatever energy policy the next President pursues, however, the likely outcome of this provision is a massive public subsidy (hundreds of billions of dollars) for new fossil-energy projects, with little to no benefit for clean energy. Here’s why. 

Section 1402 authorizes suits by developers for money damages against the United States in any federal district court where part of the proposed project is located. A developer must allege that the government missed one statutory deadline to decide on its application for a permit, right-of-way, etc. It’s up to the judge when the agency’s review clock began (there’s often dispute over when the permit application is complete) and when it ends (there’s often dispute over the degree of environmental review required). So even if the government acted in good faith to meet what it thought was the deadline, the judge can decide there’s a delay. 

Next, the developer has to show a “pattern of disparate treatment,” meaning a substantial increase (as compared to the most recent 5 years) in the percentage of projects of this type that, in the judge’s estimation, were either delayed or “improperly denied.” Here’s where clean energy comes up short. Because the current Administration hasn’t moved those projects, an indefinite stall (including by a new President that continued it) would be no worse than the baseline. Lawsuits can’t be filed until late 2027, by which time the baseline will be dominated by Trump's practices."Part 2 from Littleton: "Next, the judge decides whether the developer’s permit, were the agency to grant it, would be subject to cancellation for violating federal law. The question seems to be whether there is a hypothetical permit the agency could issue that would survive judicial review. That’s a low bar, given the deferential standard of review applied to agency factfinding and “public interest” determinations. 

Section 1402 “entitles” a developer that wins its case to (1) “injunctive relief, as provided by applicable Federal law” (meaning an order that the agency decide on the application? issue the permit?); (2) attorneys fees and litigation costs; (3) “economic damages, including any costs associated with the applicable denial or delay, as the court determines appropriate” (what else is “included”?); and (4) “damages in an amount equal to not less than 50% and not more than 100% of the total reasonably expected cost of construction of the project.” The last of these four must be repaid if the project isn’t built; the developer keeps the rest of the money regardless. 

A single claim under Section 1402 could top the total amount (~$40b) the government has paid out in all Judgment Fund claims over the last decade. This provision puts judges in real control over energy policy through the power of the purse."

- A serious effort to expedite review of permit applications would fund hiring of a large number of expert civil servants to carefully review documents in parallel. This bill does almost none of that, pushing instead to build AI tools for generating and reviewing permit applications.

Here’s a bit more detail about our Fair Share Tax proposal, for those of you who like to dig into the legislative text itself. Here are the changes in the exhibit that describe which firms get relief and which large corporations will see a hike.
7.02.400 Exemptions.
(Amended by Ordinance 192163, effective May 8, 2026.)
The Division may require the filings of tax returns or other documentary
below, the following persons are exempt from payment of the business license tax, and/or the following incomes are exempt from calculation of the business license tax:
A. Persons whom the City is prohibited from taxing under the Constitution or laws of the United States, the Constitution or laws of the State of Oregon, or the Charter of the City.
B. Income arising from transactions that the City is prohibited from taxing under
State of Oregon, or the Charter of the City.
C. Persons whose gross receipts from all business, both within and without the City, amounts to less than:
1. $500,000 for tax years beginning on or after January 1, 2028;
2. $100,000 for tax years beginning on or after January 1, 2027 and prior to January 1, 2028;
3.2. $75,000 for tax years beginning on or after January 1, 2026 and prior to January 1, 2027;
4.3. $50,000 for tax years beginning on or after January 1, 2007 and prior to January 1, 2026; and
5.4. $25,000 for tax years that begin prior to January 1, 2007.
D. Corporations exempt from the Oregon Corporation Excise Tax under ORS 317.080, provided that any such corporation subject to the tax on unrelated

When Florida governor Ron DeSantis signed a law erasing the words "climate change" from state statutes in May 2024 - colloquially known as the "don't say
climate change" law - Democrats were outraged. Just six months later, many liberal politicians began to go quiet on the issue themselves. After Donald Trump won the 2024 election, mentions of the climate crisis started to disappear from Democrats' rhetoric. As the 2026 midterms approach, that retreat is still shaping how some candidates talk about climate on the campaign trail.
The trend, known as "climate-hushing" , may reflect the
limitations of Joe Biden's climate policies, said Daniel Aldana Cohen, assistant sociology professor at the University of California, Berkeley, who studies climate politics and inequality. Green jobs and housing investments fell short of the climate movement's desires, consumer incentives disproportionately benefited wealthier households, and Democrats struggled to effectively communicate their...The climate crisis, however, is still rearing its head around the country, fueling the heatwaves, wildfires and floods plaguing communities around the US. It also lurks behind issues animating voters, from datacenter expansion to rising home insurance rates. And while some pundits have concluded from their polling and research that Americans don't want to hear about global warming, other surveys directly contradict those findings.
"Maybe people don't rank climate as their main or top issue ... but nobody really experiences everyday life like walking around the world rank-ordering the things that they care about," said Aldana Cohen, who is also founding co-director of the thinktank Climate and Community Institute that calls for "green economic populism".
"What's important is to learn how to embed the climate issue organically amidst the other issues that people care most about."Some progressive and populist candidates in the US midterms are pushing back against climate-hushing, linking the issue to economic concerns and everyday struggles. Others aren't speaking about it directly, but pushing for policies that could curb emissions. Such efforts could help build a mass base for climate policies, said Aldana Cohen.
"If we want to decarbonize fast enough and adapt to the impacts that are already here, we're going to need a robust majority that backs those policies," he said. "Elite consensus alone will not suffice ... we're going to need like large numbers of people really enthusiastic about climate policies."

I have seen "I am very concerned about this" posts and I think it's reasonable to be concerned but it is unreasonable to conclude "and so organizing to stop data centers is bad and progressives shouldn't do it." People are struggling together to define a shared future despite other disagreements.

I looked into this talking-point from I Squared when they brought it up last time (& actually asked a few colleagues who are experts in EU climate law). The Sustainable Finance Disclosure Regulation (SFDR) Articles are about the *intent* of investment funds; they don't require particular outcomes.

erroneously listed as two separate restaurants on the Go Portland Go website) -all appeared on the coalition's list as of Friday, August 28. But after the Mercury asked about the restaurant's group decision to join, Ninsom said the company would be withdrawing its support.
"When I listened to them, it's focusing on using the budget for housing the homeless, making the city clean and inviting for residents and tourists, Ninsom wrote in an August 28 text message. He added that after he received a message from his business partner, Eric Nelson, "it seemed like the organization wasn't [doing] what they understood it to be doing."
By that evening, Ninsom's restaurants had disappeared from the site.

...and that was how they attributed better mental health and healthier daily habits to PCEF. They no longer worry about leaks when it rains. They sleep comfortably. Indoor air quality improved. Lower bills and less stress. All of which led to being more active and happier. PCEF changes lives ❤️
