One thing to bear in mind about a federal permitting bill is that its mistakes would be essentially permanent - Dems could only reverse mistakes with a filibuster-proof 60-vote supermajority in the Senate. Repubs, on the other hand, could use captured courts to shave off bits their donors dislike.
