For 26 but especially 2028 it's time for Democrats to make clear that the current Supreme Court will have to be reformed (expanded in number, reformed in structure) to allow popular govt to continue in the United States. Not so much a litmus test as precondition for any other promise to be credible.

Drug trafficking is not a capital crime; it doesn’t carry a death sentence. I genuinely cannot think of anything under U.S. law that would permit premeditated government assassination of people suspected of drug trafficking.

I mean, obviously, you use whatever tools are available, and there’s plenty to do with the law. Movement lawyers always have and always will figure out ways. But if the question is, is this court going to be a dependable means of resisting fascism? Absolutely the fuck not, and often the opposite.

as for the upshot of the decision, the republican court has put the citizen children of non-citizens in a position similar to that of free blacks during the antebellum period. their right to enjoy the privileges and immunities of american citizenship will vary according to state borders

It's not hyperbole to call this case the death of meaningful constitutional rights in the United States. If you do not have an attorney that can litigate against the government, you no longer have rights. This will go down in history as the gutting of the constitutional order.

Remember that Emil Bove made sure that the case against Eric Adams would be dropped so that Eric Adams would do something exactly like this. Adams got his case dropped, and Bove got a judicial nomination. (www.lawdork.com/p/emil-bove-...) Adams must be voted out, and Bove cannot be confirmed.

Respectfully, I think you are missing what the court is trying to accomplish. They are trying to look more moderate, but in fact still allowing an outcome determinative procedure violating due process likely overturn the results of a valid election.

The Smart People said "Abolish ICE" was too radical. Then ICE kidnapped students, sent innocent people to a mega prison, broke into a car to take a mom from her daughter, and tried questioning elementary kids while lying that they had parents permission. Ask yourself: which part is more "radical"?

As in the 14th Amend Sec. 3 insurrection case, & the Trump immunity case, this Court when dealing w/Trump continues to rule as though they are facing a hypothetical scenario rather than ruling in the context of an actual executive whose conduct demonstrates the worst case scenario of abuse of power.

When a person is abducted, there's a number to call to report & identify. A habeas petition challenging the abduction is electronically filed in that district, by a lawyer admitted in that district, within 30 minutes of the call. Anywhere in the country, 24 hours a day. Nothing else is good enough.
