And if it *isn't* malfunctioning, it's just fancy computer crime, and those laws also exist. Those are the two factual explanations for these incidents. It is dangerous to pretend there is some third thing ("going rogue") that is not fact-based and feels like manufacturing consent for a loophole.

Basically. In my opinion, the best framework to use for these incidents is that of dangerous products. I am not the first to have the thought and haven't expressed it as eloquently as others, but I think it is both more accurate and more useful to describe malfunctioning A.I. through that lens.

It isnt a perfect analogy, but it feels like accepting and spreading a claim that Ford Pintos sometimes "went rogue." If companies cannot stop their programs from doing things like this, they are responsible. There is no A.I. exception to copyright, product liability, etc. Code is not an actor.

Not as if they are autonomous things with free will. This article describes a product doing crimes. Companies program and prompt them. Attempts to anthropomorphize a.i. programs or act like they are conscious are inaccurate. This "rogue" framing is a transparent attempt to minimize/avoid liability.

One of my former students just witnessed this on Orange Line in the DC Metro - ICE/HSI abducting someone from the platform of Stadium-Armory. She was scared. She didn’t know what to do. She shouted “ICE is here!” to warn others. I’m proud she did that. And she bore witness.
