Dear Ms. Tracy Casavant:
Re: Freedom of Information Request - WCB-2022 - 0861
I am writing in response to your request for access to information under the Freedom of Information
and Protection of Privacy Act (FIPPA). You requested documents authenticated by WorkSafeBC
responsible engineer, Allen P. Heinrichs, P.Eng, providing the technical rationale for COVID-19
workplace safety guidance relied upon by employers. Specifically, the authenticated work product
underpinning decisions.
In response to your request, we reached out to WorkSafeBC departments such as
Prevention Divisional Services and Credentialling and Occupational Health and Safety Practice &
Engineering Support. I received confirmation that workplace safety guidance was not provided by
WorkSafeBC’s Engineering department or any other internal group, but rather by public health.
WorkSafeBC aligned all COVID-19 workplace safety guidance to public health direction.
We also reached out to Allen Hendrichs requesting the above records. Mr. Henrichs confirmed that no
such records exist. Therefore WorkSafeBC is unable to provide you with the records you have
requested because the records do not exist in the custody or under the control of WorkSafeBC.
If you disagree with our response you have 30 days from receipt of this letter to request a review by
the Information and Privacy Commissioner (IPC). You can contact the Office of the IPC at 250-387-

Yet despite extensive documentation of public health and infection control's lethal incompetence around aerosol disease transmission, medical leaders remained stubbornly out of date - unable to learn from their mistakes, but perfectly happy to grab the authority to repeat them. May 3rd/4th, 2020:
The day before the reopening, Minister Copping released a
ministerial order titled “OHS Approved Respiratory Equipment
COVID-19.” It amended Section 246 of Alberta’s OHS Code
to approve the use of KN95 and other prescribed masks on
worksites where “a worker is or may be exposed to an airborne
biohazardous material.”271 The amendment went into
effect immediately.
Three Ministry of Labour inspectors were on site before the
harvest section opened on May 4. Four days earlier, an OHS
inspector shared their inspection reports of Cargill’s plant with
Friesen.272 On May 3, Friesen emailed Hinshaw and other AHS
officials noting that OHS had informed him of the inspection.
He added that OHS inspectors would be observing physical
distancing in different areas and that the officers would be
wearing N95 masks and face shields. Hinshaw replied: “Why will
the Labour reps be wearing N95 masks?”273 Taken together, the
minister’s order regarding KN95 masks and his officers wearing
N95 masks suggest that the ministry was, at this time, aware of
the risks of potential aerosol spread of the virus.
