Four years ago, New Democrats elected Claudia Chender to lead our party. Since then, she's become the first women elected Leader of the Official Opposition in our province. And that’s not surprising. Everyone who knows Claudia as a leader, lawyer, and mom of three knows she gets things done.

Dear Prime Minister,
I am writing to express my profound concern regarding the government’s approach to identifying projects of "national interest" before meaningful consultation with Indigenous peoples has taken place. Limiting consultation to the official announcement and identification of projects fundamentally undermines the principles of Free, Prior, and Informed Consent as affirmed in the United Nations Declaration on the Rights of Indigenous Peoples.
The current approach does not satisfy the “prior” requirement of Free, Prior, and Informed Consent. International standards are clear that Indigenous peoples must be meaningfully consulted before major decisions, approvals, or designations are made. When the federal government unilaterally determines that a project is in the “national interest” and only then initiates consultation, a foundational decision has already been imposed. Consultation after the fact cannot be considered prior consent.
Free, Prior, and Informed Consent requires more than traditional government-led consultation processes. It requires good-faith negotiations with Indigenous peoples with the objective of achieving mutual agreement. This includes respecting Indigenous peoples as rights holders and governments with the authority to participate equally in decisions affecting their lands, territories, resources, and future."

These decisions make clear that meaningful engagement must occur early in the decision-making process.
Recent jurisprudence also demonstrates an important evolution in Canadian law. Decisions such as Kebaowek v. Canadian Nuclear Safety Commission and Gitxaala v. British Columbia increasingly recognize the United Nations Declaration on the Rights of Indigenous Peoples as an interpretive framework that informs the Crown’s obligations. These cases point toward consultation processes that are more robust, more responsive to Indigenous legal orders, and directed toward achieving mutual agreement.
Parliament adopted the United Nations Declaration on the Rights of Indigenous Peoples Act to ensure that Canadian laws align with the minimum standards affirmed in UNDRIP. Yet identifying projects as being in the “national interest” before Indigenous nations have had the opportunity to participate equally in the decision-making process is inconsistent with both the spirit and purpose of that legislation.
True nation-to-nation relationships require Indigenous peoples to be involved from the outset before decisions are made and before national interest designations are assigned. Consultation cannot become a process of informing Indigenous nations of decisions that have already been made. It must be a process grounded in partnership, respect, and the pursuit of consent.
I urge your government to ensure that any framework for projects of national interest fully respects Free, Prior, and Informed Consent, honours Indigenous rights and jurisdiction, and upholds Canada’s legal and international obligations.

She references an IRCC statement from June 30 claiming 67 outstanding cases would be resolved "within a matter of days," but notes that many affected families remain in a state of uncertainty, distress, and without communication from IRCC.Page 2 of MP Jenny Kwan’s open letter to Minister Diab, featuring headings on systemic issues.
